And you have an article that came out, a secret act of judicial tyranny in a famous Supreme Court one-liner reminding the legal community of the finality of the Court’s rulings. The late Justice William J. Brennan is reputed to have said that the Constitution means whatever any five of us say it means. This reflects the basic math that five is a majority of nine. It also reflects the theory of the realism in constitutional jurisprudence. Realism is a constitutional theory that teaches that the Court can interpret the Constitution however it wants. Originalism, promoted most recently and effectively by Justice Scalia, teaches that the Constitution means what it says and the Court is subordinate to the Constitution.
So when Justice Brennan, this is not inside baseball, and I’ll tell you why in a minute, when Justice Brennan made that quip, the Constitution means what any five of us say. He wasn’t referring to the math, obviously five is a majority of nine. He was referring to the power that the Court assumes to itself to dictate what the Constitution means, even if the wording of the Constitution says something else. Fast forward to February of 2016, the Court was on recess. Justice Kagan was in Europe. Justice Thomas was driving his SUV in the Southwest. Justice Scalia was on an infamous hunting trip in Texas.
I say infamous because he dropped dead there. The Chief wanted everybody to vote by fax machine, and he demanded a vote on whether or not to stop a proposal of the Obama administration. It was a terrible proposal, but there was no case before the Supreme Court. There was no appeal pending before the Court for the Court to rule on. It just simply issued a ruling that said the decision of the Obama administration has stayed. This began what’s called the shadow docket, which today is prevalent. The Court simply says, yes, no, stop, go. There’s no interaction amongst the judges.
There’s no briefs filed by the lawyers. There’s no oral argument in a public courtroom. There’s no meaningful dialogue among the judges, the justices. They just vote. Justice Scalia voted yes, I think because he wanted to get back to the shooting. But if he had known what his fifth vote would have brought, it brought a tyranny on the part of the Supreme Court that they still use today. You heard me complain about this thing called the Kavanaugh stop. What’s that? Well, the ICE people in Minneapolis were arresting people without arrest warrants, and the city of Minneapolis appealed to the Supreme Court, and the Supreme Court simply said, they can do it.
No reasons given. No oral argument. Justice Kavanaugh wrote a concurring opinion saying, all of you complaining about your Americans and being stopped in the streets by ICE, don’t worry about it. Just carry your passport. It’s a brief stop anyway, as if this were East Germany in the 1970s. That’s an example of what happens when the court simply says, yes, no, stop, go. And then a single justice gets half-cocked, concurring from an opinion that doesn’t exist. You know, as I keep saying over and over that we need a new third party, and you should be the President of the United States, in the sense that you would bring back what this country was founded upon by our founding fathers, and when you talk about the tyranny of the Supreme Court in nothing more than little low-life politicians with arrogant attitudes.
Unfortunately, in this case, the answer is yes. Now, the court does not have an army to enforce its decisions. Its decisions are based on its credibility. When it acts in an overtly political way and doesn’t give the reasons for what it does, it loses that credibility. It undermines itself. Again, they’re nothing more than arrogant little boys and girls. What facts and data of what the Constitution means and what it says, I’ll just interpret it the way I want. Don’t you know who I am? Don’t you know who I am? And that’s what the whole country’s become.
You know, everybody forgets about, you know, about that whole COVID thing. That you had every little slimeball politician from little boy and girl mayors to whoever, governors, on and on and on, telling people what to do, how to do it, when to do it, and it’s right up to the Supreme Court. What’s Supreme Court? Nothing supreme about them. That’s a bullshit line to call them supreme from what you’re saying. You said this was not out of the ordinary since the Woodrow Wilson era creation of the administrative state. Wilson believed that the big picture constitutional decisions, taxes, war, and peace, criminal laws, should be made by Congress.
But the nitty gritty of government, how fast vehicles should travel on roadways, how many pollutants can be permitted in the atmosphere, what interest rates banks can charge should be made by experts. Unseen, unelected, unaccountable experts. That’s the administrative state. That’s what the EPA was under Obama when Chief Justice Roberts decided this yes, no, stop, go nonsense. That’s what the EPA is today. When Wilson came up with this scheme, it was very thin and there were only a few agencies. This is now two thirds of the government, administrative bureaucrats, not elected by the public, not transparent, not answerable to the public, writing tens of thousands of regulations every year.
That’s what we have become. And it goes back to Congress. Congress authorized this because Congress lacks the backbone to do its job. And again, it’s not only in the government, in the national governments, the local government. Bureau craps are the lowest piece of crap. They’re not bureaucrats, they’re bureau craps. These are arrogant little boys and girls who can’t get jobs in the real world that suck into the political system and become the most arrogant. I can tell you from what I go through with the bureau craps of where I am, and you hear it one after another after another, and you talk to people that live in Europe.
They can’t stand it anymore because of the bureaucracy. Yes, yes, the EU is one of the great disasters for European culture and personal freedom. No question about it. The governments themselves aren’t much better, but the EU is worse. Yep, it’s the FUEU. And again, the administrative state, which has grown radically since Wilson offered it, is nowhere countenance to the Constitution. On the contrary, the Constitution reposes in Congress all legislative powers, and legislation, written laws that compel and restrain, is the core function of the Congress. Under the plain meaning of the Constitution, Congress can no more give that function away to unelected, non-transparent, unaccountable experts than it could give it to the courts.
But we have a Congress that has given that power away. I remember once, if I told you this story stopped me, I was interviewing Charlie Rangel, the character now no longer with us, of a Congressman from Harlem. And one of the producers in my ear said, Judge President Obama has just announced he’s bombing Libya. Oh, I looked at Rangel. This is live television. I looked at Rangel. I said, did you know about this? Did the Congress declare war on Libya now? Don’t you care? No, we don’t care. I won’t use the language Trump uses, but it’s a hellhole.
But that’s not the point. The point is Congress allowed Obama to use the CIA to destroy Libya. Why? Because if he used the military, he’d have reporting requirements and war powers resolution requirements. If he uses the CIA, he has none of those requirements. And again, just think about it. A little ball, this little scumbag, arrogant, Nobel Peace of Crap Prize winner Barack Obama, who lied his way into office as a peace candidate. And soon as he got in, the Afghan troop surge. Remember that one? Yes. Brought to you by General Betrayas. He had betrayed us. Oh, another arrogant guy that was going to bring the war in Afghanistan, the longest war in American history.
We were going to defeat them. That’s now with KKR. Oh, yeah. KKR. Yeah. F-U-C-K-U-R. Betrayas Obama. Oh, and how about Hillary Clinton, when she’s on TV? And after they killed Obama, and she said, how do you feel about that? And she said, we came, we saw, he died. He. Remember that, that, that Obama. Yes, I do remember it. When they, when they, when they killed, that Obama killed? Yes. The Obama that’s quoted in the book double down, I’m really good at killing people. Yes. Is that the Obama you’re talking about? Yes. That’s not worth now about $40 million, a little piece of nothing before he got in there.
Yes. Same person. Yeah. And just like this guy. T-shirt I did when Clinton ran for office back in 1992. Was he worth now about $130 million? Easily. These are lying little pieces of crap that should go to hell. This is the Obama, or brought to you, the, the, if only when they were in charge, the Qaddafi war brought to you by, what, Samantha Power, Susan Rice, and Hillary Clinton. Right. Yeah. And before that, got her name is escaping me. The one who said 500,000 to children is not a bad price to pay for liberating Iraq. Madeline not, not all that bright.
Madeline Albright. Yes. Not all that bright. Yeah, I got to tell you a quick story. One time, you know, I used to do talks all over the world. And I did one for the top. Uh, vice presidents of marketing and we were on the QE two and it began when we’re in the west side of New York and Madeline Albright opens up to talk. She’s you and Madeline Albright run the same stage. Well, she was the night she opened it up. We’re still in the port in New York and she’s dressed in red. You know, it was this big thing.
I’m not kidding. About five minutes of Madeline Albright or grandfather was this or grandmother was that a father was this. She was that this work. This went to that did this, did that, did this, did that went off for five or 10 minutes. The introduction. And it was a joke. Anyway, the next day I opened the thing up, right? And they introduced me. This is Gerald Celente, you know, the author of trend tracking for trends 2000 trend tracking, blah, blah, blah, blah. And I said to the guy, thank you very much for that introduction. I said, you know, I feel short changed after hearing Madeline Albright’s introduction last night.
That went so long. I just got a short thing of it. It was a silence in the audience and then everybody broke out laughing. And I said, what you didn’t mention is I graduated without honors from PS 76 in the Bronx because they went gone going on and on about Madeline Albright did this Madeline Albright did that. It’s a joke. The whole government is a slime ball bunch of low life people that are destroying our lives in front of our eyes. And if you need any more proof, how about the guy playing President of the United States? Now that gets a terrifying every day, every day.
How can you get a price of price of oil is going through the roof because he’s got naval ships. By the way, Bloomberg reports that 33 ships, 33, excuse me, 32 got through the US naval blockade. It’s costing a billion dollars a day, the blockade. And what does it achieve? It raises the price of oil. And as our country is rotting in front of us, the roads are crap. The bridges are a joke. The subway in New York is a night in Calcutta and crap. When you look at the Chinese and other infrastructures around the world and where we’re going down, judge, who do you have coming on to talk about what’s going on in Iran war? Well, I’m ending the day with the great your biggest fan after your current humble correspondent, the great Phil Giraldi.
I also have blend these in and Pepe Escobar. But at 11 this morning, I have Joe Kent. Joe Kent is the former counterterrorism director who basically said to Tulsi Gabbard and the president, Iran poses no threat to the US and you both know it. I am very much looking forward. That took us a long time to reach him. But once we did, he jumped for joy. He is a former Republican and now a libertarian. You know, judge, Trump keeps lying day after day and gets away with it. I’m going to give you 48 hours. All right.
I’m going to give you 48 hours. 48 hours comes up. I’ll give you another day. I’ll give you another 10 days. And then you go back to Monday. He said there was going to be a peace agreement. And of course, we wrote that there wasn’t going to be any ceasefire agreement rather. And and this is on CNBC saying in the morning that and then later in the day, and he also says if they don’t agree with what he’s going to do, it’s going to be bombs away. And then he goes on to say that now it’s going to be another ceasefire.
Every day he makes a different lie up. I don’t think anybody can believe him at all. The only people that believe him and they’re starting to be skeptical is the markets. When a another administration comes in, whether it’s a Republican or a Democrat, their Justice Department is going to have a field day with the people who made a fortune on the insider trades based on what what they knew he was going to say. Yep. I mean, it’s like one thing after another. Iran war very close to over, Trump says. So that was April 15. It’s one after another.
And on March 3rd, the war started on on February 28th. Their air defense, Air Force, Navy and leadership is gone. They want to talk. I said too late. We’re doing well with the war, to put it mildly. Somebody said on a scale of 10, where would you rate it? I said about 15. Oh, that was on March 4th. One after another. There’ll be no deal with Iran except unconditional surrender. That was on March 6th. One day after another lie after lie after lie. If Iran does anything to stop the flow of oil within the Strait of Hormuz, they will be hit by the United States, and this is all capitals, 20 times harder than they have been hit thus far.
Oh, that was on March 9th. Oh, they still stopped the thing of oil, right? You know, our friend Alistair Crook is of the view that Trump’s psychosis is so serious that he doesn’t know that he’s lying, that he actually believes that whatever comes out of his mouth is truthful. That’s actually worse than lying. A liar at least knows the truth. Trump truly believes what he’s saying, which of course changes from minute to minute. This is a very, very deep mental illness. Yep. Yep. It’s just this one. You never like to say too early, you won.
We won. In the first hour, it was over. That was March 11th. That just keeps going on and on. Yeah, yeah. He said the US destroyed 100% of Iran’s military capability. That was March 14th. It’s one lie after another. And where is the outrage? How come this isn’t being stopped? And it’s what you said about Congress. It’s not Congress. It’s Congress. A-S-S. They’re low life pieces of little nothing except for people like Massey and a few others. We wiped out their leadership, phase one, phase two, and largely phase three. They want to make a deal so badly.
Again, it’s one after another. One lie after another. You ready for this one? April 7th. Trump posted on Truth Social. A whole civilization will die tonight, never to be brought back again. I think the American public is seeing through him. His approval ratings are down around where Nixon’s were shortly before he resigned. Now, this is serious, Judge. And I’m concerned, as Phil Giraldi is, and we wrote the article in this week’s Trends Journal, that they’re going to go nuclear. Because Israel’s not going to stop this war. Because the deal is that Iran made it very clear that Israel has to stop invading Lebanon.
Right. Right. So what do you think? Do you think they’ll go nuclear? I don’t know. If they go nuclear, I think the other nuclear powers will destroy Israel. Pakistan. Well, listen, everybody, go to Judging Freedom. What he has coming on today, you’re not going to want to miss, and tomorrow, and on and on and on. Judge, thanks so much for what you’re doing and what you’ve given to the people. And again, we need a man like you to be the person in charge of this country to bring back our life, liberty, and the pursuit of happiness.
Thank you, Judge. Thank you, Gerald. [tr:trw].
