The Biden administration has officially reversed a highly criticized policy that required the Bureau of Alcohol, Tobacco, Firearms and Explosives, better known as the ATF, to revoke federal firearms licenses, or FFLs, for gun shops over certain paperwork errors. That’s right. Under this so-called zero-tolerance policy, even minor, honest mistakes could cost gun dealers their license and ultimately, their livelihood.
Now, this rule was issued in 2021, and it supposedly was aimed at curbing gun crime. But let’s be real. Critics, including many of us in the gun community, have rightly pointed out that this policy was being used to punish hardworking gun dealers over minor clerical errors. Let me give you an example. Imagine filling out a firearms transaction form and accidentally writing USA instead of the county name on a background check. You just read it quick and you thought it said country. Under this policy, the zero-tolerance policy, that small mistake could shut down an entire firearms business.
Insane, right? Well, welcome to four years of the Biden administration. The reversal comes after a lawsuit filed by our friend Michael Cargill, a gun shop owner in Austin, Texas, who’s been a relentless advocate for gun rights. Cargill teamed up with the Texas Public Policy Foundation and America First Legal to challenge this rule, arguing it impeded Americans’ ability to exercise their constitutional right to bear arms. And he was 100% correct. Now, let me remind you. This is the same Michael Cargill who successfully took on the federal government and the ATF and won at the Supreme Court, overturning the bump stock ban.
This guy doesn’t back down. Now, under the original rule, the ATF could revoke a license for so-called willful violations. But what does willful really mean here? That’s the problem. According to Matt Miller, who’s the lead attorney for the case and a senior member of the Texas Public Policy Foundation, this zero-tolerance approach devastated small businesses. He explained that many, many gun stores were forced to close their doors because of what he called illegal terms of the enforcement order. Now, the question I still want to know is how many FFLs had to shut their doors because of this policy.
We may never know, but we have seen numbers released year on year that they were up, the revocations were up over 400% at some points. So there’s a lot of people who lost their livelihoods over this stupid zero-tolerance policy. But thankfully, the reversal restores previous guidance. Giving gun dealers peace of mind. They no longer have to live in fear of being shut down over honest, random mistakes. And Michael Cargill said it best, if we applied this same zero-tolerance logic to hospitals, we’d be shutting them down over minor paperwork errors made by doctors or nurses, and it’s just absurd.
The new policy is a step back toward common sense, ensuring that gun dealers aren’t punished for being human. Guys, this is a big, big victory for gun shop owners. But more importantly, it’s a win for all of us who value the Second Amendment. We are all on the same team at the end, hopefully.
