Hey friends, Peggy Hall back with you from the HealthyAmerican.org. You’ve probably heard that Biden has pardoned his son. I’m not even going to show you any pictures of these characters because I don’t have my vomit bucket handy and I did not give you a vomit warning. But we are going to talk about what did Biden do, what did Hunter do, and what are presidential pardons. What authority does a president have to do that? Can they pardon anyone at any time for anything? And then I want to share with you the number of pardons that Biden has done and compared to Trump in his first term.
And then also looking at, how do you call it the big zero? I think that’s what some people refer to that guy that was a couple of presidents back. So we’re going to talk about that. Let me know. Just give me a ballpark number of how many pardons do you think presidents do in any given term? I found it absolutely flabbergasting. So we’re going to talk about that. I had to refresh my own knowledge about presidential pardons, where that authority comes from, and let me know whether or not you agree with that whole concept and that whole idea of getting people off the hook.

Friends, I want to talk about what’s going on with these presidential pardons. Let’s start with the authority. Why does the president have the authority to do this? Well, the president is authorized by the constitution to grant a pardon for a federal crime, not the state crimes. The other forms of this power are commutation of sentence, shortening the sentence, remission of the fine or restitution, meaning they don’t have to do it, and reprieve. Now, this is interesting. A person may decide not to accept a pardon, in which case it doesn’t take effect.
So there was a Supreme Court opinion in Burdick versus the United States. That was as recent as 2021. And the 10th circuit court, the federal court ruled that acceptance of a pardon does not constitute a legal confession of guilt. So that would be why people would say, I don’t want the pardon because I’m not guilty. I find that very interesting. So under the constitution, the president’s power extends to, for pardons, extends to all federal criminal offenses except cases of impeachment. So all of these requests for clemency, for these federal offenses, are normally directed to this office, I didn’t even know existed, called the Office of the Pardon Attorney.
And that is with the US Department of Justice. They’re the ones who do an investigation and review it, but the president could bypass that office. Do you think Biden went through that office? So the constitution grants the president the power to pardon offenses against the United States. So that means a federal law, not a crime that violates state law. So it’s really interesting to me because I’m just making a conjecture here, but it seems that back when the constitution was written, giving the president the power to grant a pardon, I would think it would be for crimes having to do with, I don’t know, the revolutionary war or something like that.
I don’t know that it had to do with somebody’s laptop and other violations of federal law that we’re seeing day in, day out with some of these characters that are on the scene. So what I want to do is actually read a bit from what I think is a pretty well-written article. And this is from the BBC of all places. And it’s titled, What Did Hunter Biden Do and What is a Presidential Pardon? So Biden, the president, soon to be ex-president, has issued a presidential pardon for his son Hunter, who was facing sentencing in two criminal cases.
The move has been controversial since the outgoing president previously ruled out such a move, but he claimed that the cases against his son were politically motivated. Of course they were. His use of his pardoning powers continues a tradition of presidents on both sides of the American political divide, granting clemency to people close to them. So Biden, Hunter, was awaiting sentencing later this month for two federal crimes. In June, he became the first child of a sitting president to be criminally convicted in a case relating to gun ownership. He was found guilty by a jury in Delaware of three charges for lying about his drug use on a form when buying a handgun.
Now he was also awaiting sentencing after pleading guilty in September to a federal tax case that centered on whether he paid enough tax from 2016 to 2019. The nine charges included failure to file and pay his taxes, also tax evasion and filing a false return. He faced up to 25 years in prison in the gun case and 17 years in the tax case, although he was likely to get much shorter times to serve the two sentences concurrently. So that’s very interesting. So the constitution gives the president the broad power to grant reprieves and pardons for offenses against the United States, except in cases of impeachment.
So this, the BBC gives an opinion that says in this case, the president’s full and unconditional pardon is unusually sweeping. It covers any potential federal crimes the younger Biden may have committed during a period of more than 10 years from 2014 to December, 2024. How do you like them apples? He’s going to be pardoned from any future crimes that he might have been, that he may have committed during that decade. Stunning. And now, you know, I call him public serpents. Hunter’s not the, he may be a serpent, maybe not, maybe a private serpent.
This spans a period beyond Hunter Biden’s tax and gun offenses and dates back to the year that he joined the board of Bursima, the Ukrainian energy company, while his father, who was the vice president at the time, had a key role in US policy towards Kiev. Gee, how do you spell nepotism? How do you define nepotism? The pardon represents legal forgiveness. It ends any further punishment and it restores rights, such as being able to vote or run for public office. Yeah. In this country, that would be something Hunter will probably run for president.
The issue is relevant because there is a question mark over the sentencing of Trump in his case in New York, but he’s unable to pardon himself because it’s a state level case. I find that very interesting. I don’t know if you can pardon yourself. So here’s what I wanted to promise to tell you. How many pardons other presidents have issued. Biden up to date has issued 26 pardons. That’s not so many when we look at these other numbers. In 2020, do you remember what Trump did? He pardoned Charles Kushner, the father-in-law of his daughter Ivanka.
Ivanka’s husband’s father was pardoned. He had been sentenced to two years in prison in 2004 for charges. Sounds like Biden, Hunter Biden, tax evasion, campaign finance offenses, and witness tampering. In 2020, I’m sorry, in 2001, Bill Clinton pardoned his younger half-brother, Roger Clinton, for a cocaine-related offense that was way back in 1985. In both cases, now this is what’s interesting, with Trump pardoning the father-in-law of his daughter, and in Clinton pardoning his half-brother, these people had already served a sentence. Biden’s intervention is coming before sentencing. I find that very interesting.
How many pardons do you think Trump did in his first term? 237 pardons during his first four years in the White House. There were 143 pardons, and 94, actually, they call them acts of clemency. Out of the acts of clemency, the forgiveness, 143 were pardons, and 94 were commuted sentences. You’re not pardoned, but you get out of jail free card. Many of these happened in a flurry before he left office. That number is significantly fewer than his predecessor, Barack Hussein. It’s hard for me to spit out that name. During his eight-year stint, how many do you think he granted? The commutation where you can get out of jail or prison in this case.
Remember, I did a video about federal prison versus state prison. If you haven’t seen that, it’s an interesting one. How many of these were pardons? Barry Hussein granted almost 2,000 acts of clemency, 1,927. There were 1,715 commutations of sentence and 212 pardons. That’s a lot. He must run with a lot of bad guys if he knows all these people. Most of those who received this clemency under Obama had been convicted of narcotics charges at the height of the so-called US war on drugs. One of the most controversial presidential pardons, can you guess what that was? Granted by Gerald Ford to his predecessor, Nixon, covering acts that occurred during the Watergate scandal.
Now, that was back in the 70s. I was just kind of like a kid, but it was all the rage. Watergate. That’s nothing compared to the scandals and the controversies and the corruption going on now. I want to show you this graphic image. I think it’s really interesting. The number of pardons. Since 1945, I’m just going to throw out a couple of names and then I’ll show you the image. You tell me who you think granted the most. We had Truman, then Eisenhower, then Kennedy, so we don’t have Roosevelt. You know how I feel about him.
Kennedy, Johnson, Nixon, Ford, Carter, Reagan, Bush, Clinton, the other Bush, Obama, there I said it, Trump and Biden. This is amazing. Who do you think gave the most? Who do you think gave the least? I’m going to show you. All right. Let me show you my screen. We’ll hop on over here and we’ll take a look. So we’ve got Truman. Look at that. These were the pardons in the blue, meaning they’re done. They’re no longer, they have all their rights and privileges restored. These are the commutations of sentences where they just get to get out of prison at that point.
So look at who had the fewest. Bush had hardly any, the first Bush. Then Trump and Biden, although Biden’s not done yet, I find that really fascinating. I can’t really draw any conclusions from that other than I think it’s really interesting. All right. Let me finish up by saying that the day after Biden took office in 2021, he emphasized that he would do things differently than Trump. And his press secretary now has told reporters that the flurry of these last minute, or said that the flurry of last minute pardons by Trump was not a model for how Biden would use his own power.
He would use his own power more judiciously, even though we saw Trump had so few compared to other presidents. Biden said after son’s conviction that he would not issue a pardon. That’s how trustworthy these serpents are. In the statement announcing his U-turn on that, he acknowledged that, yeah, I had pledged to not interfere with the justice department’s decision-making, but he said the younger Biden, he’d been singled out and subjected to a miscarriage of justice. Birds of a feather flock together. All right. Trump is among those who have called Biden, who’ve attacked Biden for the move, calling it an abuse of power.
Trump also asked whether Biden would also pardon the supporters of Trumps that were persecuted over the US Capitol incident in 2021. So Trump, who has faced all the legal issues as well, has repeatedly made allegations that the US justice system is against him and his supporters. And he has promised to issue pardons of his own for those who were in Washington. The BBC says those who rioted in Washington. I would call that an opinion and not just reporting. But who exactly will be granted clemency and whether the pardons will extend to those who were convicted of the most serious offenses is still an open question.
All right, friends, I find this fascinating. I hope that you learned something as well on this video in terms of pardons and what Hunter Biden was convicted of.
