We’ve got an update here on the Illinois gun and magazine ban, and this might be the one. And I feel your eyes roll on that one of mine. Mine are too, I guess. But there’s been a powerful response from some Second Amendment groups here, and they’ve kind of come out in response to what the Supreme Court said just a week ago, when they said, we’re not going to take up this assault weapon ban case, the Snope case. Guys, early in 2023, Illinois passed the so-called Protect Illinois Communities Act, PICA or PICA, depending on how you say it. It’s a sweeping law that banned a wide range of semi-automatic rifles, pistols, and magazines that hold more than 10 rounds for long guns, or more than 15 rounds for handguns.
It was Big Ol’ Chubby Pritzker’s governor there, J.B. Pritzker. It was his response to the Bruin decision that came down in June of 2022 at the Supreme Court. Now, it includes popular platforms like the AR-15 and standard capacity magazines that are used by millions of Americans. Governor Pritzker and the anti-gun lawmakers tried to paint it as common sense, this response, a common sense response to mass shootings. Here’s the truth. They criminalized lawful ownership of some of the most commonly owned firearms in America, with no respect for the U.S. Constitution or the Supreme Court’s Bruin decision.
Fast forward to today. This ban is being fiercely challenged in federal court, and the legal battle is now in the hands of the 7th Circuit Court of Appeals. Back in April, U.S. District Judge Stephen McLinn issued a preliminary injunction against the law, essentially putting it on pause because, in his words, the state failed to show that the weapons banned by the act are dangerous and unusual under the historical tradition test laid out in the New York State Rifle and Pistol Association versus Bruin decision. Illinois appealed the ruling, and now multiple Second Amendment organizations are stepping in with amicus briefs, urging the 7th Circuit to uphold the injunction and stop this unconstitutional power grab.
Let’s talk about who’s leading the charge. There’s been a bunch of them filed, but the Firearms Policy Coalition, Second Amendment Foundation, Gun Owners of America, National Association for Gun Rights, just to name a few, as well as several state-level gun rights groups and individual plaintiffs. These organizations are not mincing words. They argue that Illinois’ ban fails every single prawn of the Bruin test. There’s no historical precedent for banning firearms or magazines based on capacity or features, and the state arguments rely on emotion and fear, not fact or law. They point out that the banned items are in common use for lawful purposes, home defense, sports shooting, and competition, and that alone makes them protected under the Second Amendment.
The idea that you can carve out constitutional rights just because the gun looks scary or holds 15 rounds instead of 10, that ain’t how the system works. And let’s not forget, the state failed to show that this ban would even reduce crime. Criminals don’t follow magazine limits. They don’t care if a firearm is banned. They don’t care if they’re not supposed to have Molotov cocktails. This only impacts law-abiding American gun owners. What happens in this case will not just affect Illinois. It will create a ripple effect across the country. If the Seventh Circuit upholds the injunction, saying you cannot enforce this unconstitutional bullshit, it sends a strong message that Bruin means what it says, the Constitution means what it says, and states can’t ignore history and tradition when it comes to gun control.
All gun control is racist and illegal. Check it out, that’s how it started. Now, if the ban is upheld, you can bet that anti-gun states like New York, California, and New Jersey, Massachusetts, they’ll all double down on the bans that they already have. And what they’re hoping for is a potential roadmap for a national nationwide magazine ban and a national nationwide semi-automatic prohibition on semi-automatic rifles. But this also could be the assault weapon and magazine ban case that the Supreme Court indicated that they’ll take up in the next term or two. Now, I think that’s BS.
There are a bunch of cowards for doing that, and they should be replaced, but that’s just how I would run the show. I also think that, you know what, our Second Amendment rights have been infringed for so damn long, let’s start infringing on the politicians’ rights and see how they like it, right? Become ungovernable. But this is why these legal fights actually matter, and we have to pay attention to them. It’s not just about the law in one state, like in this instance, Illinois. It’s about the very future of gun rights in America.
And here’s what you can do. Obviously, stay informed. How do you do that? You subscribe to Guns and Gadgets. I put out news every single day, sometimes multiple times a day, and I will keep you up to date. No BS, no twist, no slant, just straightforward. And you can also support organizations that are fighting these legal battles. Battles? Battles? Battles. That means donating to the groups like GOA, Second Amendment Foundation, NAGR, Firehouse Policy Coalition, even, yeah, the National Rifle Association, Institute for Legislative Action, the NRA, ILA. They’ve been doing some good stuff lately.
Now, groups that you support should be ones that are doing the lawsuits, filing the lawsuits, not just sending emails. And if you’re in Illinois, you need to contact your representatives and demand that they repeal the unconstitutional law and let them know that you will act accordingly. Let them know that you won’t be disarmed. Let them know that you will not be silenced. Because that’s what they’re banking on, that American gun owners are too damn lazy to pick up the phone and make their voices heard. You’re too damn lazy to show up at office hours, you know, and grab a coffee with one of these people.
You’re too damn lazy to be involved. And the truth is, most of us are too damn lazy, which is why we are where we are. Gun owners are law abiding people. We have jobs. We have lives. We just want to be left alone. We’re responsible. And we will not be treated like criminals because of what we choose to defend our families with. This fight is far from over. We’ll be following this case closely as it unfolds in the seventh and beyond. But you can believe this. And if it goes to the Supreme Court, this could be the one, guys and gals, that they indicated they are waiting for.
I don’t know why they keep waiting, because the Supreme Court should just say, you know what the Constitution has said what the Second Amendment is for a long time, not just last week, not next term or the next term after that.
