Hey guys and gals, we have a new federal bill that was submitted that would make you a felon, a criminal, just for being within 100 yards of a polling place while legally armed. Yeah, not inside, not causing trouble, just existing nearby with your rights intact, and they’re calling it the Vote Without Fear Act. Let’s talk about what the bill really does. Hey everybody, my name is Jared. This is Guns and Gadgets, your source for Second Amendment news, constitutional analysis, and restoring our rights that our founders fought and died for. If you’re new here, this channel is about cutting through the noise and giving you the facts because an informed citizenry is the last line of defense against tyranny.

And today, we’ve got a pretty big one, so let’s get into it. The Senate bill, S-4121, was introduced March 17th, 26th, by Chris Murphy of Connecticut, while the House version was submitted the same day by Rep. Raul Ruiz of California. Both are Democrats, but the real test here is going to be if any Republicans support these bills. Now, the name sounds great, right? Vote Without Fear Act, but as always, the devil is in the details. And here’s what the bill will actually do. It would create a new federal crime for possessing a firearm inside a federal election site or within 100 yards of the entrance.

And here’s the key language. It shall be unlawful for an individual to knowingly possess a firearm in or within 100 yards of a federal election site. Let that sink in. Not 10 feet, not 50 feet, 300 feet in every direction. That’s an enormous perimeter. Now, the bill defines a federal election site pretty broadly. It includes polling locations, ballot counting centers, and any place where election administration is happening. So this could mean schools, churches, community centers, and government buildings as well. And remember, these are often located in residential neighborhoods or busy public streets and public areas.

Now, let’s break down what this means for you and I. Under this bill, if you are walking down the sidewalk or driving through the area, say on the way to the range or work or whatever, or even standing outside of a building and you’re within that 100 yards of a polling place, well, you could be committing a federal crime. Now, there are some exceptions, of course. You’re allowed if your law enforcement or authorized security, if your firearm stays inside your vehicle and you’re not breaking a state law by doing that, or if you’re on private property like your home or business.

Now, here’s the catch. It still leaves huge gray areas because what happens when a polling place pops up temporarily and you don’t even realize that you’re within 100 yards of it. Well, if you’re legally carrying under the law, the bill says, if you know or have reasonable cause to believe that you’re near a polling place, you’re on the hook. So let’s talk about the consequences. You violate it up to one year in prison, fines, federal charges. But if prosecutors claim that you had intent to commit a crime, now you’re looking at up to five years in prison.

And if violence occurs, the penalties escalate all the way up to federal homicide statutes. So here’s the real question. Why is this even being pushed? It’s not like we’re having the need for this at all, right? Supporters say that this prevents voter intimidation, but let’s be honest, we already have laws against threats, intimidation, or violence. And those things are already illegal. So what’s new here? The bill doesn’t target criminals. It targets law abiding citizens because criminals are still going to criminal. That’s part of the definition. It targets people who carry legally, who follow the law and who exercise a constitutionally guaranteed inalienable right.

And it wraps it all in emotional language. But what it really does is create gun-free zones around elections, expands federal control over lawful carry, and reinforces the narrative that gun owners are inherently dangerous. So let’s bring this back to first principles here. The founders didn’t fear an armed citizenry. In fact, they relied on it. The idea that citizens must be disarmed to participate in democracy. Well, that is not American. That’s the opposite of what the Second Amendment was designed for, because voting and the right to bear arms are both mechanisms of political power and separating them.

Well, that’s not about safety at all. That’s only about control. This bill isn’t happening in a vacuum, guys and gals. We’re seeing expanded, sensitive places, designations. We’re seeing increased restrictions on lawful carry. We’re seeing federal overreach into areas traditionally handled by states. And this is part of a broader strategy. It’s incremental. It’s step by step. And it’s trying to normalize the idea that you can have rights just not here, or there, or there, or here, until eventually there’s nowhere left. And this is exactly how rights are eroded. Not all at once, because that would be too difficult for them to do, but piece by piece over time.
