A shocker for some, I know, but Massachusetts has decided that it knows better than the Supreme Court and the American people when it comes to the Second Amendment, and it has outright banned entire classes of handguns, despite the highest court in the land repeatedly affirming that handguns are protected under the Constitution. But Firearms Policy Coalition has been fighting back in this case, and they have just asked a court for summary judgment, which means let’s make this final, Your Honor. Stick around, because today I’m breaking down this major lawsuit and what it means for your gun rights where you live.

All right, let’s talk about what’s going on. Firearms Policy Coalition filed this case a long time ago and recently filed its final summary judgment brief in the case of Granada v. Campbell at the U.S. District Court in Massachusetts. This lawsuit is challenging the state’s outright ban on certain handguns, some of the most commonly owned firearms in the land. We’re talking about guns like, I don’t know, the last two generations of the Glock 19, which is one of the most popular self-defense handguns in the world.

Now, according to Firearms Policy Coalition, Massachusetts is ignoring the Supreme Court precedent by banning handguns that they deem unsafe based off of arbitrary requirements. But let’s be real here. This isn’t about safety, it’s about control, and Massachusetts isn’t the only state that has a handgun roster. So let’s break down why this ban is blatantly unconstitutional. The FPC lawsuit argues that Massachusetts is directly violating the rulings from two landmark Supreme Court cases. District of Columbia v. Heller, with my buddy Dick Heller, that’s from 2008, and the more recent New York State Rifle and Pistol Association v. Bruin, which came down in 2022.

In Heller, the Supreme Court made it crystal clear that handguns are in common use for self-defense and cannot be banned outright. And Bruin reinforced that any gun control in this land must be rooted in historical tradition, and spoiler alert, there is no historical tradition of banning commonly used firearms, especially handguns, in Massachusetts or anywhere else. Yet, Massachusetts thinks that it can just ignore that and decide for its residents what firearms they can and cannot own. But the Constitution doesn’t say, shall not be infringed, except in Massachusetts. This case isn’t just about Massachusetts, it’s about the entire country.

If this ban is upheld, any other anti-gun state can just follow Massachusetts’ lead and start banning commonly owned handguns. And this is why organizations like Firearms Policy Coalition are so important. They’re not just fighting for the rights of the people in one state, they’re fighting for the entire nation’s Second Amendment rights. And it’s not just about law-abiding gun owners. By restricting access to legal, reliable handguns, Massachusetts is making it harder for people, especially women and the elderly, to defend themselves from violent criminals. Meanwhile, do you honestly think that criminals care what’s on a so-called approved roster for handguns? Of course not.

Now, this case is going to have major implications for the future of gun rights in America. And the Supreme Court has already ruled that these kind of bans are unconstitutional. Yet states like Massachusetts just don’t care. And that’s why we have to stay informed and stay engaged and keep fighting for our rights.
