I’ve read the entire 56-page memorandum in support of the plaintiff’s motion for summary judgment so that you don’t have to. And what’s inside is explosive. Now this lawsuit is Brown v. ATF. It’s filed by Chris Brown, Allen Mayville, Prime Protection STL Tactical Boutique, the National Rifle Association, Second Amendment Foundation, and Firearms Policy Coalition, along with the American Suppressor Association. And it goes straight for the jugular of the NFA and argues that the ATF is enforcing laws Congress no longer has constitutional authority to enforce. It’s good. It’s pretty good. Strap in, because this is one of the strongest and most direct attacks on the NFA that we’ve seen.

The entire legal argument here centers on something Congress did this past summer. Something some gun owners might not realize is absolutely critical. The One Big Beautiful Bill Act signed into law on July 4th, 2025 eliminated the $200 tax on suppressors, short-barrel firearms, and any other weapons.

The NFA was always justified as a tax law. The Supreme Court said this repeatedly. The registration scheme existed only as a way to enforce that tax. But now that the tax is zero, what does that mean? Well, according to this filing, a $0 tax cannot be a tax at all. It raises no revenue. In fact, there’s a case law that goes back years. It says in order for something to be a tax, it must raise some sort of revenue for the country. So therefore, this cannot be the basis for the NFA’s registration requirements, because there’s no tax.

And if there is no tax, Congress loses the only constitutional justification for the NFA. This is the opening shot, and it’s devastating. The plaintiffs argue something incredibly important. Congress knew it had no commerce clause authority to regulate purely intrastate firearms. Back in 1934, Attorney General Homer Cummings even admitted that. He said Congress did not have the power to simply ban or regulate local firearms. They could only tax them. So what happens when the tax disappears? The entire constitutional foundation collapses. The filing states this flatly. The NFA’s regulation of untaxed firearms exceeds Congress’s constitutional authority.

And that should be checkmate, just plain and simple. This is where the plaintiffs show real world harm, something that courts love to see as well. To register an NFA item, the government forces you to submit fingerprints, photographs, personal demographic data, your home address, detailed firearm descriptions, and you must wait months for ATF approval. All of this is documented in the filing. The plaintiffs explain it took nearly 10 months for one of the plaintiffs to get a suppressor approved. Some of you have been waiting much longer. Customers refuse to buy NFA items because they do not want to submit this intrusive data to the government.

Dealers like Prime Protection are losing money because customers walk away from suppressor and SBR purchases. And remember, this entire regulatory burden is supposedly justified by a tax that no longer exists. Under the law, you can still be arrested, prosecuted, hit with a 10-year felony, fined up to $250,000, and banned from owning guns for life. That’s for every violation. Simply for transferring or possessing a suppressor or a short-barreled firearm without NFA registration. The plaintiffs make this crystal clear. They would immediately buy, sell, or transfer suppressors and short-barreled firearms today, if doing so was not a felony.

That’s a real harm. That’s standing in lawsuits, and the court has the power to end it. Even if the NFA could be justified under some other federal power, and the plaintiffs show clearly that it cannot, the filing goes further. Suppressors and short-barreled firearms are protected by the Second Amendment. The brief is crystal clear. Suppressors and short-barreled firearms are neither dangerous nor unusual. There is no historical tradition of requiring registration of protected arms. This aligns perfectly with Bruin. If an item is an arm, and suppressors and short-barreled firearms clearly qualify, and the government cannot show a historical tradition of regulating them, then the regulation is unconstitutional, period.

This filing argues exactly that, backed by historical facts, expert research, and federal case law. And if the judge accepts this argument, the NFA’s treatment of suppressors and SBRs will fail, and SBSs and AOWs. Not just for the plaintiffs, but nationwide. And this isn’t a symbolic lawsuit. The lawsuit was originally filed August 1st. This is a motion for summary judgment, meaning, judge, you can end this right now. And the plaintiffs are asking for extremely broad relief. A nationwide injunction, blocking ATF from enforcing NFA registration for suppressors, short-barreled rifles, short-barreled shotguns, AOWs, and for all current members of FPC, NRA, SAF, and ASA.

And for future members as well. Now, this would be one of the largest rollbacks of federal gun control and the biggest restoration of the Second Amendment in US history. The plaintiffs are asking the judge for summary judgment, like I said, meaning, they believe the facts are so clear that no trial is even necessary. Now, if the judge agrees, the NFA, as applied to these items, could be effectively dead immediately. No taxes, no fingerprints, no photos, no registrations, no wait times, no approvals needed. Just freedom. The way that the Second Amendment intended. Patriots, this is one of the biggest lawsuits in the Second Amendment realm in decades.
