It bans standard magazines. It strips rights after misdemeanor convictions. And it creates a framework of confiscation. All while pretending it’s about public safety. I’ll pay you money if you could show me anywhere in the United States Constitution that says you have a right to be safe in public. But I do know where there’s a right to defend ourselves. Crazy. Let’s break it down section by section because once you see what’s actually written in this bill, there’s no unseeing it. There’s no unhearing it. We’ll talk about the first section here. Assault firearms. And they’re redefining these into meaninglessness.
HB 217 massively expands the definition of what Virginia calls an assault firearm. Their term, not mine. Stop typing. Under this bill, a firearm becomes an assault firearm if it’s semi-automatic, center fire, capable of accepting a detachable magazine, and has any one of a long list of cosmetic or functional features. Just about every single gun out there. That includes things like a threaded barrel, a flash suppressor, a muzzle brake, a compensator, a folding or adjustable stock, a pistol grip, a suppressor, or simply being designed to accept one. And let’s be very, very clear here. These are standard commonly owned features on millions and millions of firearms safely owned, safely utilized across the country.
That’s public safety. The public has them and they’re safely used. This is not targeting machine guns. It’s not targeting rare weapons. One of those days. It is targeting ordinary rifles, ordinary pistols, and ordinary shotguns owned by law-abiding Americans. They’re gonna try to ban everything. And the makeup of the state with their crazy governor and their wacky attorney general is gonna pass. It’s my guess. Unless you Virginians take action. Now let’s talk about section two, which is criminalizing the purchase and transfer and manufacturing of guns. Under HB 217, it makes it a class one misdemeanor to sell, import, manufacture, purchase, or transfer an assault firearm.
That means simply buying a rifle that meets this definition after the bill’s effective date, if it’s successful, can land you with a criminal record. And remember, this isn’t limited to private sales. This applies to dealers, manufacturers, and individuals. This is a supply side and demand side ban of firearms. Now here’s where this bill gets even more dangerous constitutionally. Anyone under 21 years old would be prohibited from purchasing, possessing, transporting, or transferring any firearm defined as an assault firearm, even if it was manufactured before the band date. Let that sink in. A 20-year-old, who’s legally an adult, can vote, can sign contracts, get married, and serve in the military, can take out loans, and start a business, but under the bill cannot possess a firearm that politicians arbitrarily redefine.
And that directly conflicts with the recent federal court rulings recognizing that 18 to 20-year-olds are part of the people protected by the Second Amendment. And then there’s the next section, the misdemeanor conviction equaling temporary disarmament. This bill does something especially troubling. If you are convicted of a misdemeanor under this bill, it’s just a misdemeanor, not a felony. You are prohibited from purchasing, possessing, or transporting any firearm for three full years after conviction. Convicted misdemeanors. There are some traffic violations that are misdemeanors. Spitting on the sidewalk is a misdemeanor. Jaywalking is a misdemeanor.
Three years if you’re convicted of a misdemeanor, you don’t have a Second Amendment right in Virginia. We don’t get our rights from you, you politician pieces of trash. Now this is not a violent felony standard. It’s not a dangerousness standard. It’s punishment by paperwork. And yes, your firearms can be seized and forfeited during that period. Yeah, get in the stack. Then there’s the magazine ban portion. HB 217 bans the sale, transfer, or importation of any magazine capable of holding more than 10 rounds if manufactured after July 1st of 2026. Well, not a single magazine out there has that stuff on it, so they’ll never really know, will they? But 10 rounds.
That means standard AR mags, many pistol magazines, common home defense equipment, all become contraband by legislative definition, not function. This ignores decades of Supreme Court precedent, stating that arms and common use are protected. I know, I know. The politicians in Virginia know better than anyone else. I get it. I mean, it’s good to want to be king, I guess, right? But then there’s more. They’re going to try to basically eliminate private sales. The bill further tightens private transfer of firearms by requiring mandatory dealer facilitated background checks, additional fees, criminal penalties for paperwork errors as well.
And then it flatly prohibits private sales of any assault firearm. That’s not regulation, it’s elimination. And then there’s forfeiture and confiscation. If a firearm, magazine, or accessory is possessed in violation of this law, it is automatically forfeited to the Commonwealth, subject to destruction or disposal by the state. Hey Virginia, come and get them. The line is drawn, the patriots are done. We’re done. Come and get them. Stack up or shut up. This is some stupid enforcement mechanism dreamt up by people who believe in the land of unicorns and rainbows. They want to criminalize ownership, confiscate property, and destroy evidence of lawful exercise of rights.
Under the Supreme Court’s Bruin standard, the government must show a historical analog from the founding era, supporting modern restrictions. Virginia can’t do that here. There is no historical tradition of banning common firearms. There’s no tradition of disarming adults under 21. There’s no tradition of banning standard magazines. This bill would collapse under any constitutional scrutiny, but only after years of litigation. Hundreds of thousands of dollars in costs, or more, and damage to lawful gun owners. Which is why it’s key to kill bills before they become law, which is why everybody in Virginia and everybody in the country should consider joining the Virginia Citizens Defense League.
I support everything they do. They’re phenomenal people over there, and they get stuff done. And they’re trying right now to do everything they can to fight against what looks like the inevitable. But they need your support to do what they’re doing. HB 217 is not about safety. It’s about control. It turns normal gun owners into criminals. It punishes possession, not behavior. And it treats a fundamental right as a state issued privilege. If you live in Virginia, or if you care about what spreads to other states, you need to pay attention to this bill, because what happens in Virginia doesn’t stay in Virginia.
