Judicial Watch just reached a historic $4.975 million settlement with the federal government in its wrongful death lawsuit on behalf of Ashley Babbitt’s family. Babbitt, a 35-year-old Air Force veteran from San Diego, was shot and killed by U.S. Capitol Police Lieutenant Michael Byrd on January 6, 2021. Judicial Watch filed the wrongful death lawsuit in January of 2024, alleging the facts speak truth. Ashley was ambushed when she was shot by Lieutenant Byrd. Multiple witnesses at the scene yelled, You just murdered her. The lawsuit continues. Lieutenant Byrd later confessed that he shot Ashley before seeing her hands or assessing her intentions, or even identifying her as female.
Ashley was unarmed. Her hands were up in the air, empty, and in plain view of Lieutenant Byrd and other officers in the lobby. Judicial Watch President Tom Fitton had this to say about the multi-million dollar settlement. This fair settlement is a historic and necessary step for justice for Ashley Babbitt’s family. Ashley should have never been killed, and this settlement destroys the evil, partisan narrative that justified her outrageous killing and protected her killer. President Trump was an absolute rock in supporting Ashley’s family and advocating for justice. Judicial Watch previously exposed Lieutenant Byrd had a lengthy disciplinary history with the Capitol Police, including a 2019 incident where he left his loaded gun in the Capitol Visitor Center’s bathroom, and an incident at his D.C.
home where he fired his service weapon at a fleeing vehicle. He also had an unhinged outburst at a Maryland high school football game where he accused the local police department of racism.
