Summary
➡ A judge has ruled that the Office of Personnel Management (OPM) unlawfully directed federal agencies to fire employees, using a template termination letter that suggested poor performance. The judge ordered the reinstatement of all employees fired under these circumstances and prohibited the use of the OPM’s template. The judge also criticized the Trump administration for not producing the acting OPM director for testimony. The case highlights the importance of checks and balances in government to prevent power concentration.

Hey friends, Peggy Hall back with you from the healthyamerican.org. Did you see the headlines? Yes, it’s Government Run a Musk. No more. Oh, let’s take a look here, shall we? There is a judge that today, all right, I’m recording this, this is Thursday, March 13th, 2025, and the judge calls Doge firings a sham orders thousands of workers to be reinstated immediately. Well, I guess this is no longer my favorite Martian. You know that TV show, I only saw it in reruns, but it was about my favorite Martian, this guy that came from Mars, but it’s Musk that wants to go to Mars.
So I guess he’s everybody’s least favorite Martian, at least today, because of these headlines. And I wanted to share a couple of pictures with you. It says it’s a major setback for Ellen’s government destruction project. All right, this was actually published in a media outlet called Gizmodo. But in a moment, we’re actually going to go to an executive government website where I’m going to share with you the judges ruling. But I thought this was an interesting picture that they chose. You see what he’s doing with that hand gesture, I pointed this out in a video where he was at the CPAC conference, and he did the gesture as above so below, I’m not going to expose you to images of the evil one, the Baphomet, the devil, fill in the blank.
Basically, he does this gesture a lot. And that just is in a line with all of these other Illuminati gestures that he does. Here is the so above. How many times have you done either of these gestures? I ask you, don’t be blaming it on his Asperger’s. I don’t even know if he really has it. Who knows? I think it’s a cover story for just being such a weirdo. And this is another Illuminati gesture. I will do a whole video for you all about the signs and symbols. And you’ll see different celebrities, politicians, just individuals that are signaling that they are in the club that you and I ain’t in.
And that’s another one of the gestures. He likes this one quite a bit. These are ones that I’m compiling. Only the first one was in the article. But I want you to take note of his bent thumb here. And of course, this is his love salute. Don’t be confusing with any sort of Nazi gesture. You know, Hitler was just sending out his love to everyone there during World War Two. And I did a deep dive on that if you would like to see it. Here it is again. Look at those bent thumbs. And I’m going to break this down for you because he’s doing it here.
And this is intentional. Do you ever do your thumbs that way? Well, what a coinky dink. Not my favorite Martian. Does that same gesture here? Oh, it’s just a coincidence, Peggy. You are reading too much into things. There’s another one that we see all the time. It looks very unnatural, very posed. Just the picture of masculinity. Yes. Many of you are asking me to cover this gender fluidity of Ellen Musk. I don’t even know if I can stomach that. I think you can draw your own conclusions. You know what females look like, how God made them, and what males look like, how God made them.
Okay. This is a very brief summary from that Gizmodo article. A federal judge has dealt a blow to Ellen Musk’s doge agenda. On Thursday, Judge William Alsop of San Francisco said that the firing of tens of thousands of probationary workers had been based on a lie and that the government had conducted the expulsions illegally, further calling the initiative a sham. We’re talking about San Francisco, friends, a very liberal outpost there. Alsop ordered that the workers be reinstated immediately. Probationary workers, that is workers who are new to the workforce, but actually let me stop for a moment because probationary workers aren’t necessarily those that are new to the federal government.
You could be a government worker who is promoted to a new position, and now you’re a probationary worker, even though you’ve been working for the government for dozens of years. So that is not actually accurate to just say that the probationary workers are brand new to the federal government. They have suffered massive cuts across the government as Doge and the Trump administration have attempted to greatly reduce the federal workforce. You may be in favor of that. I probably am to a certain extent, but done within the confines of the Constitution. You just don’t do things willy-nilly.
That’s why we have checks and balances. We don’t have the chainsaw, which a very astute healthy American pointed out that she thinks that Musk wearing the chains and his little me, Musk wearing the chains and the chainsaw are all alluding to the blockchain, which is where we are all moving. Apparently to a cashless society, I’m going to be the last one standing using cash. I think a few of you will be alongside me. So this judge’s reinstatement order applies to thousands of federal workers who were fired from the Defense Department, the Department of Veterans Affairs, the Department of Agriculture, the Department of Energy, the Treasury Department, and the Department of the Interior.
Keep in mind that Musk obliterated, eviscerated, abolished so many in these agencies. These were the very agencies that were investigating his violations that I have pointed out. I think I have to do an update because there was a report that came out from the House subcommittee on the judiciary. I don’t know if they’re watching the Healthy American, but they are listing these violations that I uncovered, and I want to make sure that I have that list that is up to date. Now, what’s interesting is that the USAID has its own lawsuit, and that is still active.
But let me read to you now. It’s called Government Executive. Let me just show you this website to let you know what my source is. I like to draw from a variety of sources, and the Gizmodo was a little more snarky and cheeky, and this comes from Government Executive. By the way, I just subscribed to their newsletter so I can find out exactly what’s going on. The judge orders reinstatement for most fired probationary federal workers. Now, the subhead, the firings were based on a lie. I would like you to let me know if you are aware of what the issue is and how these firings were done basically outside of constitutional authority.
So I’m going to read to you this article, which sums it up. It just came out a couple of hours ago, which is why I wanted to report on it, March 13, 2025. The Trump administration must reinstate to their jobs federal employees it is fired in the last months at six of those departments that I just mentioned. The judge called these terminations unlawful. So this is Judge William Alsup of the U.S. District Court for Northern California, a federal judge. He said that these agencies were directed to not make any excuse for delaying the rehiring.
So there are close to 25,000 federal employees in their probationary periods, typically those hired within the last year or two, or those who were promoted that have been federal employees for some time. And the agencies can quickly fire them, but it has to come from those agencies, not outside the agencies. They will regain their jobs as a result of this decision. So the order impacts all of the fired probationary staff from the Department of Veterans Affairs, Agriculture Defense Energy, Department of the Interior, and the Department of the Treasury. Alsup said that he may extend this injunction to other agencies in the future.
And there is the American Federation of Government Employees, that union and other groups that have brought the lawsuit. So the judge made clear that the Trump administration, like any other, can indeed engage in mass reductions of the federal workforce, but it must do so following federal statutes and the Constitution. Call me old fashioned, but I like to stick to the letter of the law. That’s why I engaged in a lawsuit against the public serpents at the Orange County Board of Supervisors. And I have updates that are in my playlist on my lawsuit.
And basically, it’s just in a stall right now. And I stand in victory, because you know, and I know that they were wrong. And what else was uncovered through all of that was the wrongdoings and the felonies that were done by Andrew Do in conjunction with his daughter and others to the tune of about $10 million. So I stand before you in victory. So Alsup actually referred to himself and he said, this is not some wild and crazy judge in San Francisco. That said some administration cannot engage in a reduction of force, but they have to follow the federal statutes and the Constitution.
Here’s the problem. The Office of Personnel Management, the same office that sent out that email that said, let me know what you’ve been doing all week. Do you think that’s still happening? Talk about lack of efficiency. It’s really ridiculous. These employees don’t even report to the Office of Personnel Management. What’s going to be next? The government’s going to be asking you what you did. And is Bob Kennedy going to be asking you how many calories you took in and how much junk food you ate? How much exercise you did? Yeah, I’m not in favor of the government getting into our business like that.
So the Office of Personnel Management was the one that directed the agencies to carry out the firings and they don’t have the authority to do so. So the judge concluded that these firings circumvented those established procedures. The judge also added that the Office of Personnel Management provided a template for federal agencies to use as termination letters. Gee, reminds me back in the days of the religious exemptions where you were just given a template from Kaiser or your employer saying you’ve been denied and there was no reason for that. So OPM provided this template, OPM, interesting, isn’t it? OPM provided a template for federal agencies to use as a termination letter for the impacted staff, which suggests that employees were being fired for poor performance.
He cited an example of an earth science employee at the agricultural department, at the agriculture department being fired after receiving only outstanding performance reviews. And the Justice Department lawyers that were arguing the case were being dishonest in making that assertion, in making that assertion. The reason that OPM wanted to put this based on performance was at least in my view a gimmick to avoid the laws the judge said. He added it’s a sad, sad day when our government would fire a good employee and say that it’s based on performance. When they know good and well, that is based on a lie.
It reminds me for those of you that were fired, not because you didn’t take the jab, but they came out with some other excuse saying, oh, your position now has been terminated. I know, and I don’t care for those traps and that slimy, those slimy tactics. The judge’s order specifically calls for these agencies that I just mentioned to reinstate all of the fired employees that were fired on February 13 or February 14 or any day they’re about immediately and notify them that their terminations were found to be unlawful in court.
The agencies further should cease in using the template that OPM provided and the human resources agency is now prohibited from issuing any guidance related to probationary firings. How do you like them apples? I think them are pretty good apples. Thursday’s hearing got off to a testy start as Alsup denied, as Alsup derided the Trump administration for defying his order to produce acting OPM director Chuck Ezell for testimony. Can you believe this? The judge says, I want this man to appear in my court and the government said, no, we’re not going to produce him.
It’s absolutely shocking. And the judge now will be able to offer some kind of sanctions, maybe even throw the guy in jail. I don’t know. The Department of Justice said his testimony wasn’t necessary and they withdrew, they even withdrew the written declaration that he had submitted to assert that he had never ordered the firings of probationary employees. The judge said, why can’t you bring in your people to be cross examined or deposed at their convenience? Adding that the refusal to do so was a sham. He said, it upsets me. Well, it should upset him.
The Trump administration submitted press releases from agencies alluding to the firings, which justice attorneys said demonstrated that they made the firing decisions on their own. Alsup said, no way. These press releases are not the same as the actual email and documents coming from the director of OPM. Oh my gosh. He rejected that argument. And he said there were several examples of agencies stating to employees that they were taking the actions per the OPM instruction. So there’s a separate case challenging the probationary firings in federal court in Maryland and other officials are disputing the Trump administration’s arguments because the arguments really don’t hold water.
So there we have it friends, the employees performances were never evaluated by those deciding to fire them, nor were their positions reviewed in relation to the Trump administration priorities. So here’s an example. Tracy Demartini served as the chief human capital officer at the IRS until she was placed on administrative leave earlier this month. She also submitted testimony on the case in which she said her boss at the treasury department relayed that the firings of close to 7,000 IRS employees must take place because the OPM ordered them. In all my decades of human resource management, she said, for the federal government, I had never before received a directive such as this one.
Typically the decision to terminate a probationary employee lies solely with the probationary employees manager. She added that OPM’s directive was plainly an effort to reduce headcount and did not involve any evaluation of the job performance of the probationary employees. So I think this is a step in the right direction friends. We have three branches of government. We have the executive branch, which is headed up by Ellen Musk. We have the legislative bodies, the Congress and the Senate. And then we have the judiciary branch, including the federal courts, judges, and they are intended to provide checks and balances so that we don’t have power concentrated into one branch, such as the executive branch.
We saw very history has shown us what happens when there is concentrated power by one ruler. That’s not our political system. Maybe government run a musk is going to be reined in a little bit because apparently this transhumanist globalist does not understand exactly how our constitutional republic is supposed to run. Well, judge Alsup is taking him to school. All right, friends, thank you for being on board. Tomorrow we’re going to be talking about tariffs. I’m going to give you an overview. And then next week we’re going to do an entire series that I am titling the tough truth about tariffs.
Many people are asking me to do a deep dive about tariffs, about trade deficits, trade surpluses, the balance of trade, fair and balanced trade, if there even is such a thing. Who pays the tariff? What effect it has? Historically, what has happened? Does the president actually have the authority to issue tariffs? How long do they last? So we’re going to be doing a deep dive on that. It’s actually an area of interest for me. I studied international economics when I was getting my master’s degree in international policy study. So I’m happy to dust off the books and do a deep dive and we’ll talk about that next week in an entire series.
For now, thank you so much for being on board. I appreciate you being healthy Americans. Be sure to get on my free sub stack, peggyhall.substack.com.
