A judge has made a good decision that could help us really really soon. This rule looks to mandate or threatens to mandate that ordinary gun owners engaged in lawful activity must become licensed as federal firearms licensees or FFLs complete with all the warrantless inspections and paperwork requirements that come along with being and maintaining your FFL simply to sell your privately owned firearms in an entirely personal and non-business capacity.

All right, now traditionally law-abiding Americans have been able to buy and sell firearms from their personal collections, largely without government intrusion or oversight, and certainly without the fear of being labeled as a dealer that is engaged in the business of dealing in firearms by ATF. Well, ATF is looking to rewrite the Constitution, to rewrite the American blueprint and make citizens become FFLs for no reason. Well, we know there is a reason, guys and gals, don’t we? It is a giant registration scheme.

That’s what this is. This is their universal registration scheme that they’re looking to go around Congress on. Now, once ATF forces everyone to be licensed to sell their firearms, they will know exactly who has what and exactly where they live. And don’t forget about Joe Biden’s zero-tolerance policy on FFLs, either. Once they get your FFL information, they will find some type of clerical error in your books and revoke your license. It was all part of the comprehensive strategy to prevent and respond to gun crime and ensure public safety, which Biden announced.

And in that, he was targeting what he called rogue gun dealers. That was the plan all along, y’all. You and I would be those rogue gun dealers if we were to sell our legally obtained item that are constitutionally protected, like we’ve been able to do forever. Under Biden’s policy for zero-tolerance, revocations on FFLs have increased by 3,040%. 3,040%. All of that includes ATF has even reopened old cases that were previously resolved, and they’ve gone back and given harsher punishments under this policy. So it’s been like an ex post facto thing as well.

Sell your gun, and you might get criminally charged. And the rule is clear as mud, just like all ATF rules, and that gray area creates confusion for people, which creates situations where ATF can shoot your dog, raid your house, and as we have seen several times, unalive you, and if they don’t unalive you, put you in prison for 10 years and $250,000 per violation. All that for doing what has been legal in this country since before this country was a country. Well, one of those lawsuits that we have against ATF and DOJ regarding this rule was launched by Gun Owners of America, Gun Owners Foundation, Tennessee Firearms Association, Virginia Citizens Defense League, the states of Texas, Louisiana, and Utah, as well as an individual named Jeffrey Tormey.

Now, the judge in this case has agreed to our people, the good guys’ request, for an expedited briefing schedule. What does that mean? It means the judge has fast-tracked this case. Here is his order. It’s pretty simple. It says, Before the court is plain of unopposed motion to set expedited briefing schedule on their motion for preliminary relief filed May 10th of 2024. Plaintiffs seek relief from the defendant ATF’s April 20, 2024 final rule, which goes into effect on May 20, 2024. The court accordingly grants the motion for an expedited briefing.

The parties are therefore ordered to comply with the following briefing requirements. The defendant’s opposition to plaintiff’s motion for preliminary relief is Tuesday, May 14th by 5 p.m. Central. And then the plaintiff’s reply, in support of their motion for preliminary relief, is due Wednesday, May 15th by the close of the day, 5 p.m. Central. And this was ordered by Judge Matthew Kaczmarek, U.S. District Judge in the Northern District of Texas, the Amarillo Division. And this is great. I mean, this is big news, because usually it takes a while to where the rule goes into effect after these challenges are heard by judges.

Well, the ATF has until tomorrow evening to respond, and our side has to respond the following day. Now, this means we could, we could have a ruling before the date the rule goes into effect of May 20th, 2024, which is exactly what this lawsuit was looking to do. So, I want to go on record again and say thank you to those groups who are putting forth time, effort, and money to fight the ATF and DOJ. Support those that support you, guys and gals. Follow these groups, become a member of these groups. It costs less than a pizza, for crying out loud.

Thank you, and the individual who put his ass on the line as well, suing the ATF. This has to stop. We have some positive momentum, and I will keep you in the loop.
