It’s a major federal case, and they’re urging the court to strike down Illinois’ sleeping assault weapon ban and magazine ban, and it’s big, big, big. So stick around. I’m going to break down exactly what it means, how it impacts us, and why this could be a serious turning point in the fight for the Second Amendment. All right, let’s set the stage here. Illinois. A couple months ago, they passed a law called the Protect Illinois Communities Act, a sweeping gun control package that was banning so-called assault weapons, standard capacity magazines, and a whole range of firearm accessories. They framed it as a public safety measure, but let’s follow what it is. It’s a blatant attack on our rights. The law criminalizes possession of common firearms like the AR-15 and standard 30-round magazines that are used every single day for home defense, sporting, shooting, and competition. But here’s where things get interesting. A federal district court issued an injunction against the law saying that it likely violates the Second Amendment.
And now, here comes the twist. The Trump Department of Justice, the new Department of Justice, just filed a brief asking the appeals court to uphold that injunction. This is a firearms policy coalition, Second Amendment Foundation, Illinois Rifle Association case, and it’s really, really big. Let it sit in, guys. Let it sit in. The DOJ actually sided with gun owners, at least on this run. So what exactly is the DOJ argument here? Well, in their brief, they hit Illinois hard on two major points. First, they said AR-15s are protected arms. The DOJ agrees that the AR-15 and standard similar rifles are not dangerous and unusual.
And they say that these firearms are in common use, why they own by law about Americans, and clearly are protected under the Second Amendment. They even cite Heller and Bruin, the Supreme Court’s landmark decisions to show that these types of bans don’t hold up to constitutional scrutiny. They even quoted Clarence Thomas in the Snope case that they took up, or failed to take up a couple weeks ago. And in their own words, the AR-15 qualifies as an arm because it is commonly used for lawful purposes like self-defense. That’s straight from the Department of Justice. It’s crazy.
Second, the magazine ban and accessories are also unconstitutionally banned. The Illinois law doesn’t just target rifles, it also bans magazines that hold more than 10 rounds. And the DOJ here points out that over 100 million of these magazines are already in circulation. That’s not dangerous and unusual. That’s common everyday ownership. The DOJ also argues that other accessories like suppressors and stabilizing components, if commonly used, fall under Second Amendment protections. Big case, dude. Big, big, big filing here. In the state, they fail to show any historical tradition of banning these items, which is now the only test that matters under the Supreme Court’s Bruin decision.
So let’s dig a little bit deeper here. Excuse me, I’m shaking. But under New York State Rifle and Pistol Association v. Bruin, which was a 2022 Supreme Court decision, gun laws now have to meet a two-step test. One is the item covered by the plain text of the Second Amendment, and two is the historical tradition of banning it. The DOJ says both answers favor gun owners here. Yes, AR-15, magazines, and other components are arms. And no, there’s no historical tradition of banning them, especially not in the late 1700s or the early 1800s when the Second Amendment was ratified.
In fact, the DOJ points out that there were no widespread bans on firearm types, capacities, and accessories in the founding era. So Illinois is completely out of line trying to invent one now. The case is a big one, not just for Illinois gun owners, but for Americans everywhere. If the Seventh Circuit upholds the injunction based on this brief, it would reinforce the idea that states cannot unlock common firearms or standard magazines, no matter how they rebrand them as assault weapons. And even more importantly, it shows that the Second Amendment is winning even in the courts. Even the Department of Justice can’t ignore the Supreme Court’s clear rulings anymore.
This brief could influence other cases as well, like those challenging bans in California, New York, and elsewhere. And it’s one more piece of the legal ammunition needed in the fight to restore the Second Amendment. So let me be clear here. We’re not out of the woods yet. The fight is far from over. But when even the Department of Justice is saying, yeah, this violates the Constitution, you know momentum is swinging in a way. So if you live in Illinois or any other anti-gun state, don’t give up.
