TikTok. A lot of y’all was crying over the weekend. What was that? Saturday night? Saturday night, TikTok went dark. And then Trump saved y’all from y’allself, similar to how he did in the ceasefire. Check it out. Today, the Supreme Court ruled to uphold a law that would prohibit the use of TikTok in the US. The justices unanimously determined that the law requiring the hugely popular act to either be sold or banned in the nation does not violate the First Amendment. The court also said the measure is necessary to address quote, well-supported national security concerns.
The CEO of TikTok posted his response to the decision on the app. On behalf of everyone at TikTok and all our users across the country, I want to thank President Trump for his commitment to work with us to find a solution that keeps TikTok available in the United States. This is a strong stand for the First Amendment and against arbitrary censorship. The president-elect also responded on social media this morning saying quote, the Supreme Court decision was expected and everyone must respect it. My decision on TikTok will be made in the not too distant future, but I must have time to review the situation.
Stay tuned. CBS News Supreme Court and legal producer Catherine Cole is following all of this in Washington for us. So Catherine, can you further explain the court’s decision, particularly how the justices concluded this law does not violate the right to free speech. Yeah, so this is a unanimous 9-0 decision saying that this law doesn’t violate either Americans’ free speech right or TikTok’s free speech right. What they concluded is that this law indirectly burdens speech, but that laws that further an important governmental interest can have these indirect burdens on speech so long as they don’t go too far.
And the court said the data privacy problems that Congress identified that the government has defended, that the Chinese parent company of TikTok can access the data of anyone who has TikTok downloaded onto their phone. Somebody says in the chat, let me share this real quick. I want to share this statement because you know the chat is my co-host. Where is it at? Where is it at? I talked about how great China is. I’ve studied China, studied it back and forth, even learned a little bit of the language. Somebody says, Lisa Lisa says the algorithm is setting us up to keep us none down.
China is teaching tech stuff. Jaren also says, I like red note, China make America look like a third world country, check out Chinese cities. Y’all are absolutely 100% confused about what China really is. Actually go and speak to somebody who’s been there. All right. Number one, let’s talk about red note. Okay. Because I know that a lot of people was trying to flock over to red note a Chinese app because they didn’t want to be on American apps and stuff like that. All right. Let’s go about this. Let’s, let’s, let’s first had this conversation.
Okay. A lot of people that joined these Chinese applications that’s also owned by ByteDance, which is the parent company of TikTok, they don’t play the same way that they play over here. I’ll give you an, I’ll give you an example. There were a lot of people that were complaining about red note right after they switched over because they thought that TikTok was going to be off for a long time and they were complaining to them because they were getting removed off the application. Why were they getting banned off a red note? Because A, they was talking about politics.
B, they were talking about whole behavior and C, they were not dressed appropriately and they were showing cleavage and they weren’t covering themselves up. I don’t know if y’all familiar with this and maybe y’all need to go over there and live over there and see what it’s like. They present, they present a image over there that’s completely different from what the real experience is. More importantly, they censor. You can’t send an email from over there in China without being held accountable if you say something that you wasn’t supposed to say in the email.
It’s filtered through and then released after a certain period of time, sometimes up to 24 hours after you send an email. You cannot say anything. For example, you see how y’all be complaining about Trump or Biden and stuff like that, how we could just say what we want to say. You can’t do that over there. You cannot criticize leadership over there. They will have you in a concentration camp immediately. You can’t have your titties out. You can’t do 304 talk. You can’t do what you want to do. See, because a lot of people don’t appreciate the freedoms that they have over here because they’ve been free for too long and they haven’t been held accountable for their actions because we got freedom of speech and we have laws that allow for you to do what you want to do because you’re governed by the Constitution instead of it being a democracy.
You think that you’re cool and you think that it’s sweet over there. Oh, man, he’s living in 2077. No, they’re not. They’re being controlled and they’re being made to do. They’re told what they’re going to do when they’re born. You wouldn’t survive over there because you don’t really know what it’s like. Do you know why women, when they get pregnant, fly to the United States of America and try to hide their pregnancy so they can have their children here so their children can have dual citizenship, both here and in China? Do you know that those are manmade cities that their real estate is absolutely crumbling right now, that their infrastructure is cheap, that they tried to dump cheap steel over here, that eroded some of your cars and that’s one of the reasons why y’all have some of the recalls that y’all have.
Y’all think it’s so cute and it’s so, oh my god, they so great over there. Then go. Go. While everybody is trying to get over here, nobody is trying to run over there. Go over there. Go over there and tell them about your choosing to use men’s bathrooms or women’s bathrooms. Go over there and tell them about how you don’t like their government leadership. Go over there and start telling them about what you think you know and how you feel about women’s liberation and why you need to eliminate babies. Go over there and tell them what you’re going to do.
I want you to have the same energy, have the same energy that you got over here. Go over there and tell them that you’re going to do it and let me see, let me know how I go. I’m just curious because what they allow for y’all to do on the apps over here, they’re looking at you when they’re laughing at you and they think that your content is subpar and they controlled by their own government. But that’s a real problem. Congress judged that was a problem and that the court isn’t going to say that Congress didn’t have a sufficient basis to assert that interest nor that that interest wasn’t important.
And so the court concluded basically Congress did what it needed to do here and we can’t overstep what Congress has decided. How surprising is it that the decision was unanimous? You know, not that surprising. I’ll give you two reasons why. The first is that the lower court ruling is also unanimous and that court also had Republican appointees, Democratic appointees. We got a show to do. We’re not distracted by nothing. We got a show to do. Basically every judge who has looked at this law has said it passes constitutional muster. And then also the court is unanimous more often than you’d think.
In roughly half of the cases it gets, the court rules 9-0. It tends to be the more controversial high profile cases where they tend to split. And that’s where you get this perception, perhaps misperception, that the court is more divided on the law than you’d think. And President-elect Trump has previously indicated he wants to save the app. This is a reversal for him as well. Can he? Does he have the power to? I’m not sure. I think he said he’s going to try. He needs some time to review the situation. That’s what he said on Truth Social.
But the problem here is that this law is a matter of federal law. It supersedes executive authority per se. And it acts on the intermediaries, the tech companies that stand between users and TikTok. So the app store, the cloud service providers, whatever you use to get to TikTok, those tech companies will face serious penalties right now if they allow you to get to TikTok. So let me show y’all, let me bring y’all up to date. That was prior to the ban and that was the anticipation of the ban once the Supreme Court ruled.
And then this was more recently after it was banned. And then TikTok decided that they wanted to go ahead and get their servers back online. In addition to Oracle, Oracle was actually the service provider that allows for TikTok to be able to be filtered through your phones and stuff like that. So once it was banned for a little while and you couldn’t access it, you quickly seen it come back online. By the time that I was on my flight in the morning, it was back online. And this is the conversation that Trump was having and what he issued in order to allow for them to be able to come back online.

I’d like to get to an update regarding the social media platform TikTok, which initiated a blackout on late this Saturday evening. A lot of reports coming in for the future of TikTok. But I’ll bring you this, a post on accident. I’m about to give Quentin his own show, y’all, on after hours. It’s about to be sports and sports betting. Quentin is, let me tell you something. Tomorrow we’re going to talk about it.
But Quentin is the Oracle. My heart sunk when he texts me because I said, man, listen, I’m not listening to you. I just shut my phone off for a while. First I said, I take that bet. He said, man, I think the lion’s going to get blazed. Listen, Anton, they’re going to lose. I said, I’ll take that bet. And then I just turn my phone off. I said, man, I’m not about to have him predicting this game for me. And then the next thing you know, I was just looking at the, I was just looking at the TV, 31 points in the first half.
See of the Associated Press saying breaking TikTok says it’s in the process of restoring service to users in the U S and thanked Trump who pledged to sign an executive order after his inauguration. Speaking of the president elect, we also have a statement here from him via truth social. It’s up on your screen right now. And it says this quote, I’m asking companies not to let TikTok stay dark. I will issue an executive order on Monday to extend the period of time before the laws, prohibitions take effect so that we can make a deal to protect our national security.
The order will also confirm that there will be no liability for any company that helped keep TikTok from going dark before my order. Americans deserve to see our exciting inauguration on Monday, as well as other events and conversations. And also this post on eggs from a TikTok policy. So it’s a little cut off, but I’ll read it to you in full. It says in agreement with our service providers, TikTok is in the process of restoring service. We thank president Trump for providing the necessary clarity and assurance to our service providers that they will face no penalties providing TikTok to over 170 million Americans.
So let me break this down for people in the back from a business perspective and exactly what I believe that Trump is doing. Okay. Trump is about running up a bag here in America. And he’s also about making sure that he protect national security. So what does that mean? One of the reasons why Congress voted to ban TikTok here in the United States of America is because they didn’t want all of our data and our information to go over to China. In addition to manipulation through TikTok of what happens here in the United States of America.
All right. That’s one of the things, but here’s the thing. TikTok is a multi-billion dollar corporation, and it actually helps fund a lot of the businesses and small businesses and people that are generating a significant amount of revenue here in the world. Allowing for the ban just to be what it is because the Biden administration basically passed the buck and they say, listen, we don’t want to touch it. We’re just going to let Trump rock out with it. Once TikTok went dark, because as some people are saying inside of the comments, they say, well, Anton, you don’t see it inside of the app store.
You don’t see it inside of the Microsoft store. You don’t see it inside of the Google store. You don’t see it inside of the Apple store. Well, here’s how it works. The service is back up. So if you already had the application, then you still are able to use the services. They’re not allowing you to download it inside of the app store because the laws are still in place that says that any service provider that helps them, basically the people that are putting it in the app stores, any service provider that helps them could face billions of dollars in penalties.
Well, what does that mean? That basically means that Trump is extending and he said it. Let me read the statement again. He is extending the ability for them to be able to go online for 90 days while a deal is a deal is broken. So basically what he’s trying to do is he’s trying to secure a deal where the United States of America basically takes at least a 50% stake of what happens here inside of the United States of America, as well as more privacy concerns that are then solved for. So basically the same thing that China does to us, where anytime an American company decides that they want to open up a business over in China, or they want to do business in China, then China then takes practically 50% of whatever it is, or they got a partner, 50%, whatever a Chinese company is inside of their country.
That’s basically what’s happening here inside of America. He’s saying, why would we remove that wealth? Why would we then prevent ourselves from being able to take advantage of the amount of revenue and jobs and technology that’s here in the United States of America by way of it? Why won’t we then make sure a deal is done to where we are favorable on that side of the deal? And I can get the credit for brokering another deal to make sure that everybody is happy. Everybody get what they want. Any United States of America is more empowered as a result of it.
So Apple and Google and the Google Play Store and all of these places, they’re choosing until their concrete laws on the books to not allow for you to be able to download it from their stores. But at the same time, if you already have the application, you can still use TikTok like you did before. That’s what the 90 day man is. That’s what the 90 day state is. Now they’re trying to get a deal done to where basically a holding company or whoever it is that wants to buy it gets at least a 50% stake in it.
Trump is trying to see that through. But basically TikTok is depending on, the CEO of TikTok is depending on Trump to execute on his word through executive order to not find them or to not hold them accountable for the things that happen or them coming back online to be able to provide the advertisers and the TikTokers and the servicers and all of the people that depend on the app for their income to be able to run up a bank. Apple and Google and them, they’re saying, oh, we’re just going to wait and see what happens because we want Congress to actually join in and Trump just joined office.
Actually, the TikTok CEO is at the inauguration right now and he’s cozying up to Trump. And so he got to bend the knee. They got to bend the knee. So I’m going to stay on top of it. More importantly, shout out to all of the people that was hating on Trump, but then at the same time, they depended on him in order to save TikTok because you need TikTok. And I get it. It’s a lot of people. It’s his own economy, right? But shout out to all of the people that’s depending on Trump to save TikTok.
