Let’s talk about what some are saying is an abuse of government power and police, indiscriminate use of force, and they could have a case here. What if I told you that January 6th is not just about criminal cases anymore, but now the United States government itself is being sued? And for what these plaintiffs say was indiscriminate violence against American citizens exercising their rights? I want to hear what you think about this one because I know this topic divides this country, but hear me out first and see what you think about this.

This lawsuit, even if partially proven, could completely reshape the narrative around what happened on that day. So stay with me because this one matters. Hey everybody, Jared here with Guns and Gadgets, your source for Second Amendment news, constitutional analysis, and stories that the mainstream media will not fully unpack. If you’re new here, I break down the facts, the law, and the history so that you can understand exactly what’s happening and why it matters to our rights. And today we’re going to dive into a brand new federal lawsuit tied to January 6th that raises some serious legal and constitutional questions.

So here’s what’s happening. A class action lawsuit has been filed against the United States government under the Federal Tort Claims Act, and it alleges that law enforcement used excessive and indiscriminate force on January 6th. We’ve all seen the videos. I’m not going to show them here because I think just the fact that I said the the month and the date together is going to get this all jammed up anyway on YouTube. So we’re going to try to minimize the flack. Now this is not speculation. This is coming directly from the legal filing itself.

According to the complaint, this case centers on Capitol Police and DC Metro Police actions on the west side of the Capitol. And here’s the key claim. Law enforcement allegedly fired chemical munitions, projectiles, and used physical force against a crowd that plaintiffs describe as mostly peaceful. Now let’s break this down and take a peek at the allegations because this is where things get very serious. According to the complaint, around 106 pm police began deploying force into the crowd. It included pepper balls, a CS or tear gas, flashbang grenades, sting ball grenades, and 40 millimeter impact rounds.

And the key allegation was that this force was used indiscriminately. The lawsuit specifically claims that the munitions were not targeted at individuals engaged in violence. Instead they were fired into broader sections of the crowd. Even more, this went on for over an hour. And according to the filing, officers themselves acknowledged on video that these munitions were quote hitting innocent people end quote. Now here’s the critical legal issue in the case. The plaintiffs argue that no dispersal warnings were given. And that matters because under DC law, where this took place, police were required to give three clear warnings before using force against the crowd.

But the lawsuit claims that no warnings, verbal or otherwise, were issued before use, before force was used. If that’s proven, that’s not just a procedural issue. That becomes a constitutional issue tied directly to the First Amendment. The plaintiffs are not just arguing theory, they’re claiming real harm. And according to the filing, the injuries included chemical burns, concussive injuries, emotional trauma, loss of income, long-term physiological effects as well, sorry. And one plaintiff specifically alleges being hit in the face with a projectile. And if you know anything about use of force, that is a red area and you cannot use an impact tool or projectile in a red area because that is a high likelihood to cause serious injury and potentially death.

So if that’s proven, and they figure out who should fire that round, that’s a different issue altogether. Now after being hit in the face, that person was, and it claims they were then exposed to additional chemical agents. Now this is why this is being brought as a class action because they claim this wasn’t isolated. They’re saying that hundreds, possibly thousands of people, were affected. Now let’s talk about how they’re bringing the case, because this is where it gets interesting. They’re using the Federal Tort Claims Act, which allows citizens to sue the federal government for negligence, wrongful acts by federal employees, even assault in certain cases.

And the lawsuit includes three major claims. Number one is negligence. They argue that law enforcement failed in their duty to protect citizens from unreasonable harm. Number two is assault. They claim the use of force created immediate fear of harm and in many cases actual physical harm. And number three, negligent supervision, and this is on every law enforcement lawsuit and it’s because it’s big. They allege leadership failures, specifically command staff not present on scene, poor coordination, failure to control officers, and tactical mismanagement, which is weird because usually you always see like failure to train all kinds of extra stuff on there, but that’s what’s on the complaint.

Now the complaint goes even deeper here. It specifically calls out leadership, including capital police command structure and on scene incident commanders. The claims are that there was a lack of coordination, poor intelligence sharing, and a failure to properly control escalation. I wonder if they’re ever going to, they should put Nancy Pelosi on this because she had a direct hand and why this all unfolded that way that day. But again, everybody has their opinion. In other words, they’re not just blaming individual officers. They’re alleging systemic failure from the top down, which is why I say that you’re going to go from the top down, go from the person who that day decided not to have extra coverage there.

I mean, that should be part of it, but now let’s zoom out a bit because this is where it matters for every American. The plaintiffs argue that they were exercising their first amendment rights and that they were peacefully assembled using free speech and petitioning the government. Now here’s where this ties into everything we talk about on this channel, because when government forces used against citizens without warning, without targeting, and against people exercising constitutional rights, that raises serious questions about limits of government power, accountability, and yes, how force is justified against civilians.

This case could have major implications. If the plaintiffs succeed, even partially, it could establish limits on crowd control tactics or forced policy changes in federal law enforcement and open the door to more lawsuits tied to January 6th. Also, it could potentially expose internal decision making from that day, which is why they should have Nancy Pelosi’s name attached to this and as well as the the master at arms from the from the house. So there’s a lot of more people that could have to just lawsuit. And remember, this is not a criminal case.

This is about civil liability and government accountability. So let’s be clear, because this is important. These are allegations, not proven facts. The government will absolutely defend this case, likely arguing that the officers were responding to a rapidly evolving threat, that force was necessary to secure the capital, and that conditions justify the escalation. And that’s going to be the central legal battle. Was the force reasonable or excessive and indiscriminate? This is one of those cases where I’m going to keep a close eye on this one, because no matter where you fall, the viewer, no matter where you fall politically, the question is the same.
