They hate us. I know I don’t need to tell you that, but here’s some more proof right in our faces. Welcome back to Guns N’ Gadgets, your premier source for Second Amendment News. I am Jared. I am still half-dead with this crud, but we’re pushing through. And today, I’ve got a story that I want to expose, I want to spread, and you’re not going to want to miss this one. The now former FBI Director Christopher Wray presented now former Attorney General Merrick Garland with a Tommy gun during Garland’s farewell ceremony in Washington, D.C. And as you might expect, it’s raising some serious questions about hypocrisy, legality, and ethics.

Why? Well, for several reasons, really. We’ll discuss some of them here, but this past administration was the most anti-gun group of tyrants we’ve ever had assembled all at once since probably the founding. From Biden all the way down to the unelected bureaucrats, they launched attack after attack on the Second Amendment with the goal of just whittling it away as much as possible because a disarmed populace is one that’s easily controlled. A Biz Pack review recently reported on this, and the internet was quick to call out the double standard. After all, this is the same FBI and DOJ that aggressively prosecuted American citizens for firearm-related offenses.

There’s something that happens every day, and I put out a video every day at least once a day. Here’s what we’re talking about. So on behalf of the 38,000 men with the FBI, I want to present to you your very own Tommy gun. I just want to be sure this is legal. Where’s the ATF director? As you just saw, on January 16th, during Merrick Garland’s farewell address, Christopher Wray stood before the crowd and said, on behalf of the 38,000 men and women of the FBI, I’d like to present you your very own Tommy gun.

Now, depending on what exactly this gun is, this so-called gift raises all kinds of legal and ethical questions. Now, let’s be clear. Tommy gun is a machine gun under the National Firearms Act, the NFA. It’s not outright banned federally, but it is highly restricted, requiring ATF registration and approval. It’s also outright banned in Washington, DC, where the gifting took place, as well as 13 other states. That could also be a semi-automatic version, but that’s on the banned list as well in all these places. Now, here’s where things get really interesting. The FBI and the DOJ regularly prosecute American citizens, ordinary folks, for alleged NFA violations, yet the top law enforcement official in the country is casually handed what appears to be an NFA-regulated firearm, with a 50-round drum, which is also banned in DC, no less.

Where’s the ATF paperwork? Was this legally transferred? Or are the ruling class simply above the laws that they impose on the rest of us? Now, commenters were quick to call out the hypocrisy. One user said, with a freaking 50-round drum, talk about a high-capacity magazine. Now, the big question is, is the gun real? That’s the million-dollar question here. Firearms expert Len Savage took a closer look at the footage and noticed something important. I’ll try to point it out here to you, a red muzzle plug. This typically indicates a non-firing replica, guys. Now, he noted that it could be a real firearm with a red plug, like a barrel flag, but more likely it’s a resin or metal replica.

There are also hollow, non-functional drum magazines out there, so we can’t assume that it’s loaded. However, without an actual examination, we just can’t be certain. If it is real, it raises serious legal issues. Even a deactivated war trophy, which are called DEWATS, they still qualify as NFA firearms under federal law. Many people didn’t know that. And if this were an operational machine gun who authorized its possession and its transfer, under U.S. Code 18, USC 922-O, new machine guns can only be transferred under strict circumstances. Did the FBI and DOJ follow the same laws they enforce on us? To get to the bottom of this, my friend, attorney Steven Stamboulia has officially filed a FOIA request, the Freedom of Information Act.

This request seeks records on the firearm’s origin, status, and legal status of its transfer. Given the last administration’s history of stonewalling transparency, we’ll see if the FBI and DOJ comply. He did this on behalf of David Codrea, who also wrote about this in AMOLAND, and here’s the actual FOIA request. This was sent to the FBI on January 27th, and it’s to their FOIA officer. It says, this is a request under the Freedom of Information Act. I represent journalist David Codrea in this request. Because this information sought is believed to be with your agency, Mr. Codrea directs this FOIA to your agency.

During Attorney General Merrick Garland’s January 16th farewell address, FBI Director Christopher Wray presented him with a Tommy Gun, an event widely reported in the news and recorded on video. The purpose of this request is to determine if the gun was real, if it was functional or deactivated, or if it was a replica, and to determine that all applicable federal laws, District of Columbia ordinances, and Department of Justice ethics policies for gifts to employees were complied with. As such, Mr. Codrea requests the following records. One, all records regarding procurement of the Tommy Gun, including all transfer documentation and costs, or if applicable, purchase records, including compliance with bidding requirements, and showing who authorized and paid for the purchase, and the total amount paid.

Two, all records establishing compliance with Justice Management Division’s Departmental Ethics Office Gifts and Entertainment Policy. Three, all records pertaining to that specific Tommy Gun. Four, records regarding Attorney General Garland’s last date of employment, and if applicable, records of compliance with all regulations for transferring functional, deactivated, or replica machine guns, including communications with and approvals by the Washington, D.C. Metropolitan Police Department. Mr. Codrea is willing to pay up to $100 for the processing of this request. Mr. Codrea also requests a fee waiver, as these materials are greatly in the public interest, and because the requested records will be distributed free of charge on the Internet, and will increase the public’s awareness of the workings of government and federal-state partnerships.

Additionally, because Mr. Codrea would be considered media, he is entitled to a free waiver. Pursuant to FOIA, Mr. Codrea anticipates your response within 20 business days.
