Ah, I got a good one for you. What if I told you the government has been secretly monitoring your gun purchases, and they don’t want you to know about it? That’s right, folks. The ATF has been running a surveillance program that tracks the legal firearms purchases of American citizens, and when a lawsuit forced them to hand over the documents, they accidentally let slip the truth. Then they demanded those documents be hidden from the public. Yeah, First Amendment. Transparency. Gun owners of America took them to court, and now they’re fighting to expose the ATF’s unconstitutional actions.

But the government is scrambling to keep things under wraps. I’m gonna break this down for you, what it also means for our Second Amendment rights, and why this could be one of the biggest gun rights battles so far. This all started nearly four years ago when Gun Owners of America and Gun Owners Foundation filed a Freedom of Information Act request against the Bureau of Alcohol, Tobacco, Firearms, and Explosives, otherwise called the ATF. Now they were asking for information on a secret government surveillance program that allegedly tracks firearm purchases of law-abiding Americans. This is a direct violation of federal law which requires the destruction of NICS records within 24 hours and bans the creation of a federal gun owner registry.

But here’s where it gets crazy. During the lawsuit, the ATF accidentally released unredacted documents exposing critical details about their surveillance program. Realizing they made a big mistake, the ATF immediately demanded Gun Owners of America claw back, which is a term that means to return the documents. They wanted GOA to claw back the information even though it was already legally obtained. And guess what? A judge went along with it, ordering GOA and their lawyers not to even talk about the documents, let alone use them. Let that sink in. The government messed up, admitted their wrongdoing, and instead of facing consequences, they used the courts to silence those who looked to expose them.

For the last 17 months, Gun Owners of America has been legally gagged, unable to report the news, or advocate for gun owners, or even discuss their own legal case. Where else have we heard of that? Oh yeah, Judge Murshon, or whatever his name was, in New York when he wouldn’t let President Trump talk about his own case. Now this is nothing short of a direct assault on the First Amendment. Even after multiple legal motions, the court refused to reconsider its own unconstitutional protective order, which prevented GOA from speaking publicly about the information they had lawfully obtained.

Makes sense, right? Now this means that for almost a year and a half, the government has successfully kept the truth hidden from the American people. But then a major court ruling changed everything. In January this year, January 2025, the U.S. Court of Appeals for the D.C. Circuit issued a game-changing ruling in a very similar case, saying that courts do not have the power to order the return or destruction of accidentally released FOIA documents. This ruling completely destroys the legal basis for ATF’s protective order against GOA. Even though the ruling is crystal clear, the ATF is still doubling down, trying to stall and keep the information hidden for as long as possible.

I will repeat what I said in yesterday’s video. Cash Patel is now the head of ATF. And yes, I know these are Biden holdovers who are still doing this. As the lead of this organization, it is now his responsibility. Cash Patel, you need to stop this stuff and you need to stop it rapidly. But GOA is not backing down. They filed a motion to lift the protective order, arguing that, 1. The government has no authority to claw back documents legally obtained through FOIA. 2. The First Amendment protects their right to report on government misconduct. And 3.

The ATF’s secret surveillance program violates federal laws designed to protect gun owners from government overreach. Now it’s up to the court to do the right thing. End this unconstitutional gag order and let the truth come out. This case isn’t just about one organization, it’s about all of us. You know what, I’m on the same team. GOA, if I could somehow get those documents, maybe I’ll just talk about them. If the judge wants to find me in contempt, that’s a win for the country. Now if the government can spy on law-abiding gun owners, and then use the courts to silence those who expose it, what’s next? If we don’t fight back, this sets a dangerous precedent for government control, censorship, and unconstitutional surveillance.

We need every gun owner, every patriot, and every defender of the Constitution to stand up and say enough is enough. That means supporting groups like Gun Owners of America in their legal battles.
