This all started with a case, George Peterson, the United States versus George Peterson. He pled guilty to possessing an unregistered suppressor, which under the National Firearms Act is a felony that carries up to 10 years in prison and up to a quarter million dollar fine. A panel of judges upheld his conviction saying that suppressors are not arms protected by the Second Amendment. Case closed, right? Wrong. Peterson asked for a rehearing en banc, which means the entire court.
And that’s when the United States, yes, the same government that prosecuted him flipped his position. This happened today. They admitted on record that suppressors do fall under the protection of the Second Amendment. Guys, gals, that’s huge because it not only challenges decades of anti-gun legal precedent by DOJ, it undermines the ATF’s entire justification for treating suppressors like contraband. The DOJ argued that even if suppressors aren’t technically arms, regulations on them still impact the right to keep in their arms because they’re integral to the safe and effective use of firearms. They compared it to the First Amendment.
They said you can’t tax newspapers by the sheet of paper and claim you’re not violating freedom of the press. Likewise, taxing and restricting suppressors burdens your rights. And they didn’t stop there. They cited military use, personal protection, and hearing safety as legitimate reasons why suppressors help people exercise their Second Amendment rights. Now here’s the catch. You know there’s always a catch. While the DOJ now admits that suppressors are protected, they’re still defending the almost 100-year-old National Firearms Act. They’re saying, well, this is just a modest tax and registration requirement. No big deal. But we all know what that really means.
$200 tax stamps, a wait time of up to 12 months or longer, and a registry of gun owners. That’s not modest. That’s an infringement disguised as bureaucracy. Now, they’re arguing that suppressors can be specially adapted for criminal use. But let’s be real here. Criminals aren’t filing ATF Form 4s. They’re not paying taxes and they’re not waiting a year or more to get permission. This only affects law-abiding Americans. To justify the law, the DOJ says this kind of restriction has historical precedent, pointing to 1800s-era taxes on buoy knives and sword canes. Yeah. That comparison fails. Those were state laws targeting weapons of the time that they saw as unusually dangerous.
A suppressor today is just a muffler for your gun. It reduces noise, protects your ears, and helps prevent hearing loss. Even the Marine Corps agrees. There’s over 4.5 million of them in circulation by civilians alone. So if the military sees value, why are we burdening civilians who want the same protection? Why should I be forced to go deaf for my family to go deaf if I have to protect them in my own home? This moment’s historic, guys and gals. The federal government now concedes what we’ve been saying for years. Suppressors help your safety and effectively exercise our Second Amendment rights.
That’s not an opinion. It’s now their legal position. But this isn’t a full victory yet. They’re still defending ATF’s registry, taxes, and delays. That’s why we need to keep the pressure on Congress, the courts, and these legislatures. If you believe full deregulation of suppressors is past due, then call your representatives and senators and demand support for the Hearing Protection Act. It’s working its way through the Congress right now in the big beautiful bill. It’s time to stop treating law-abiding Americans like criminals for wanting to protect our ears.
