Montana is making waves this week with their house bill 574, which is known as Red Flag Law Prevention Act, or the Red Flag Law Prevention Act, and it passed the House and it passed the Senate and it now sits on the governor’s desk. And the bill does exactly what its name promises. It proactively blocks the enforcement of red flag laws within the state.

This legislation is a powerful defense mechanism against a disturbing trend that we’ve seen sweeping the country. One where constitutional rights are tossed aside based on suspicion, hearsay, or outright political bias. Now all eyes are on Montana to see if they’ll officially join the ranks of states pushing back hard against federal overreach and due process violations. And if you’re wondering why this is such a big deal, let me break it down for you real quick. Red flag laws allow for someone’s firearms to be confiscated without a criminal charge based on nothing more than a petition from a family member, a cop, or sometimes even a neighbor.

There’s often no requirement that the gun owner even be present in court to defend themselves before the order is issued. That’s called ex parte. Now that’s a clear, clear violation of due process and it undermines the very foundation of the justice system. Montana’s House Bill 574 would prohibit any state or any local agency or their employees from enforcing any order issued under a red flag law, whether that order comes from within the state or from federal authorities. It essentially tells DC, not here, not in Montana. Red flag laws have a history of being used improperly, often against gun owners who haven’t committed a crime.

And that’s not public safety. That’s pre-crime policing and it has no place in a free society. Opponents of the bill, on the other hand, argue that red flag laws are a tool to prevent tragedies before they happen. But what they won’t tell you is that these laws almost always lack transparency, accountability, and fairness. They’re ripe for abuse and they open the door to weaponizing the legal system against law abiding citizens. As for Montana governor Greg Gianforte, the bill is on his desk and he’s got a very strong pro to a track record.
