Well, once again, unsurprisingly, of course, once again, the federal government, specifically the Department of Justice, the self-proclaimed, you’ve heard me say it before, self-proclaimed, most two-way friendly Department of Justice ever, which is easy to accomplish when all of them have been anti-gun. But this DOJ that says they love the Second Amendment is pushing their same tired narrative. Gun control keeps you safe. The NFA is reasonable. The government must regulate your rights.

The Commerce Clause justifies Second Amendment infringements. Well, I got news for them. This is the United States of America, not a permission-based dictatorship, and today I’m gonna break down exactly why their arguments fall apart when held up to the light of history, the Constitution, and the undeniable truth that our rights do not come from government. The DOJ continues to argue in court filings, briefs, in public statements that gun control laws like the National Firearms Act are essential tools that, you know, regulating our suppressors, regulating our short-barrel rifles, or our shotguns, even our homemade firearms, is a necessary part of public safety.

Nowhere in the Constitution, if you take time to actually read it for the first time, nowhere does it say you have a right to public safety. It sure as hell does say I have a right to keep and bear arms. Now the DOJ, they always, the government, they always phrase it in terms like reasonable regulation or modern necessity or balancing interests. But every single one of those arguments rests on a lie. The lie that the government has the authority to regulate a pre-existing right. The Second Amendment doesn’t grant anything. We don’t even need it on paper.

It recognizes something older than this government itself. We already had it. And the founders were crystal clear. Thomas Jefferson said, no free man shall ever be debarred the use of arms. Pretty solid. Samuel Adams also said, the Constitution shall never be construed to prevent the people of the United States, who are peaceable citizens, from keeping their own arms. Now if you’re new here, that doesn’t sound like reasonable regulation to me. That sounds like hands-off our rights. Now let’s bring in one of the biggest, most foundational Supreme Court cases in American history.

Marbury versus Madison, way back in 1803. Why? You probably haven’t heard of it. Because this case established a principle that the government pretends does not exist. A law repugnant to the Constitution is void. It’s not questionable. It’s not debatable. It’s void. Meaning if the DOJ defends a gun amendment, that law has no force, no legitimacy, and no rightful authority over the American people. James Madison himself, the father of the Constitution, warned us. His quote was, we are right to take alarm at the first experiment on our liberties. The NFA, the National Firearms Act, was one of those experiments.

So the Gun Control Act was as well. The Hughes Amendment was as well. The FOPA restrictions, ATF rulings, interpretations, policy guidance, all of that. All that stuff that magically turns Americans into felons overnight when they’re just law-abiding citizens. Void. The Supreme Court said so. And this is where we are gonna get brutally honest. Some folks believe still that the DOJ might one day repeal gun control. Or that a politician, no matter who, red or blue, will suddenly undo unconstitutional laws and restore liberty. Newsflash. They won’t. And history proves it. The DOJ defends gun control under every single administration, Republican or Democrat.

It doesn’t matter. They defended brace rules. They defended the NFA. They defended the Gun Control Act. They defend the ATF rulemaking that Congress never passed. The Founders warned us. Thomas Jefferson, well, the quote is attributed to him. I’ve never seen it actually where he said it, but it’s attributed to Thomas Jefferson. He said, quote, a government that fears its people has liberty. A people that fear their government has tyranny. I mean, it’s, you can’t really see it because it’s behind me, but it’s right there. It’s something that I love. I love that quote.

And right now, Washington DC expects you to fear them. A bunch of soft, meek, meager hacks in some cheap suits that wouldn’t last a three-minute round with any of us. But the Constitution expects something very different. The truth that most politicians hate with a passion. The Second Amendment belongs to we the people, not to the DOJ, not to Congress, and not to whichever president is signing executive orders at the moment. Our founders designed a system where the people are the ultimate check on government power, and they gave us the means to stay that way.

We have the right to speak freely. We have the right to petition our government. We have the right to assemble. We have the right to vote, and we have the right to bear arms. The final guarantee of all the rest. George Mason put it perfectly when he said, to disarm the people is the most effectual way to enslave them. The DOJ’s vision of America with endless gun control, permission slips, taxes, background checks, registrations, and approved firearm configurations, is the exact opposite of freedom. Their vision only works if you believe you are powerless.

But patriots, we are not powerless, and we never have been. Every major Second Amendment victory in the last decade or longer didn’t come from the Department of Justice. It didn’t come from some president. It didn’t come from Congress. It came from people, individual people, pushing back. Heller, McDonald, Catano, Bruin. These wins didn’t happen because the DOJ wanted them, or gaslighted us saying, just give us time, have some grace. They happened because patriots refused to surrender their rights. I’m blessed to know Dick Heller, and I tell him every time I see him, thank you for what you have done.

Benjamin Franklin warned us, those who would give up essential liberty to purchase a little temporary safety, deserve neither liberty nor safety. Well, here we are, and the DOJ is still asking you to give up your liberty. And we’re saying, no. The Founding Fathers didn’t fight an empire so that their descendants could beg the government for permission slips to exercise a God-given right. They didn’t write the Bill of Rights so that bureaucrats could reinterpret it in a memo. They didn’t spill their blood so that the ATF could tell free men and women how short their barrels needed to be.

Freedom is not given. Freedom is claimed. Freedom is defended by we, the people. And, patriots, that means us. Because at the end of the day, we, the people, are the power in this nation. We, the people, decide how free we will be. And we, the people, are the last safeguard to what’s left of this republic. The DOJ won’t restore liberty, make no mistake.
