Hey everybody, welcome back to Guns and Gadgets. Well, where am I? I’m actually on the set of my new show on the We the Free Network. It’s Keep and Bear News. Check us out. But I’ve been hearing many, many whispers about an announcement coming from the White House related to the future of National Firearms Act enforcement under the Trump administration.
And I took yesterday off to spend time with the wife and kids, so I figured I’d tell you today. Just so you can be aware and pump the brakes, and I’ll tell you why. Administrative action is not law. It’s not what we were hearing on the campaign trails when, you know, the president was saying, you know, on day one, I’m going to get rid of the pistol brace rule. And on day one, I’m going to do this. Or even the campaign trail for these pro-2A Republicans who were saying things like, we’re going to abolish the ATF, and we’re going to do this or that.
None of it’s come to fruition. But I want to talk to you about, can we actually abolish the ATF as our Congress is currently constituted? That’s the catch here that a lot of people seem to miss because I get a lot of comments, and I go back, you know, and we have conversations and comments and emails about why this isn’t happening. So I want you to understand what’s happening. I want you to be aware of this announcement that’s coming out. And I’m going to tell you a little more about why we can’t abolish the ATF right now, and that’s called 60 votes, the filibuster rule in the Senate.
You need 60 votes to invoke cloture to overcome the filibuster. And as we saw a couple weeks ago during the hearings where Pam Bondi was pitching the Department of Justice’s proposed budget, and she was getting grilled by members of Congress on it, we heard there that you can’t just get rid of an agency without legislation. Yeah, 60 votes in the Senate. We even saw reference to that with the Senate parliamentarian during this whole big beautiful bill back and forth. So you need 60 votes in the Senate to defeat the filibuster. But, but this is the big but.
Regardless, realignment is going to happen. Realignment. What do I mean? Well, I’m going to explain that to you. But first, I want to thank the sponsor of the video. And that’s Aura. I’ve heard some people say, you know, let’s just get rid of the filibuster.
John Thune, the Senate, they can do that. They can, but that’s a double edged sword guys and gals. You know, the next anti gun administration will do the same thing because if you get rid of the filibuster, it’s just this simple majority vote, which a isn’t the way it should be because elections have consequences. And if you have a big swing to either side of the aisle, then they can just ram things through whether it’s anti gun or what have you anti gas stove doesn’t matter. No, it’s a dangerous thing. And I don’t support getting rid of the filibuster.
But I will say that this realignment that is going on, it can also be undone by the next attorney general. So it’s, again, a double edged sword. Some of the things I hear are happening in this realignment will be beneficial. But again, it can be out undone on day one of the next administration. See, the attorney general can move manpower around as she see fits, as we saw when she removed or Pam Bondi, the attorney general, she moved ATF agents to the border to help with securing the border, right? She will still move assets where ATF will work closely.
That’s the key. They’ll work closely with DEA, the Drug Enforcement Agency under the same umbrella, not an actual merger, because that’s, you know, that requires legislation that requires 60 votes. It’s also nothing, nothing even close to abolition. Like we were told, you know, it’s abolish the ATF. But in the eyes of the law, she can move assets around, but they’ll still be two independent three letter agencies just working together closely, which in and of itself is very bad for the Second Amendment. Why the DEA is better funded. The DEA has a bigger scope.
The DEA has bigger tactical teams. So embedding ATF or not embedding is having them work closely is what Pam Bondi’s wording is. It’s still very dangerous for gun owners. You know, yes, they can remove positions, they can use layoffs, they can utilize unfilled vacancies, terminations or even early retirement to tweak staffing legally. And they will do that. All thanks to the Supreme Court’s decision last week regarding President Trump’s power to fire federal employees. So they will do that. Now back to the whispers here, coming out of the White House here soon, regarding the NFA here, and the enforcement going forward under the Trump administration, I want you to pump the brakes because whatever comes out can and will be undone on day one of the next administration, especially if it’s a democrat administration, you can guarantee it that they’ll over they’ll undo it, whatever it is.
That’s not the way we are supposed to do things here in this country. This is not going to be a new law. It’s not going to be an actual effort to rescind the NFA law or anything associated with it. So keep that in mind. You know, what’s coming is going to sound good from what I’m told. But it’s not. And also, I’ve been asked a bunch here in the last two weeks since this big beautiful bill was signed. What about, you know, bills like HR 38, you know, reciprocity, or the bills to abolish anything, NFA, ATF, or the whatever, any any bill right now, unless it has strong bipartisan support, none of it’s happening.
We’re not going to get 60 votes in the Senate for anything pro-gun, period, point blank, hard stop. And that means not only how would we get 60 votes, you would have to have every single Republican vote in favor of the bill and then you would still have to have Democrats cross the aisle and join the Republicans. And if you think that Republicans are going to get Democrat support on abolishing ATF or the IRS or anything else, I don’t think I don’t think that’s the case. Otherwise, they would have moved and they would have moved quick.
So, you know, the only thing that changes that status, as is currently constituted, is elections. You have to strengthen the majority in either either chamber, free the party, whatever party you support. And Republicans that ran on the Second Amendment and promises of abolishing the ATF or getting short belt rifles, short belt shotguns, et cetera, off of the National Firearms Act. And even the ones that didn’t have the stones to overthrow the partisan bureaucrat swamp creature parliamentarian in the Senate, that’s Senate Majority John Thune, they’re the ones who let us down.
Remember, it was Republicans that ushered in the Bipartisan Safer Communities Act under the Biden administration when the Democrats did not have the votes in the Senate to get it done. Thanks, John Cornyn. You did that. And just like they did with Trump’s border policy, his deportation policy, the reduction of the Department of Education, and anything else that he has attempted to do since day one, there will be lawsuits to stop it immediately. The only reason we got as far as we did in the National Firearms Act attempt here in that reconciliation bill, the one big beautiful act it’s now called, because it’s now law, is because of you, your voice, we the people, you all made the phone calls when I was helping to direct to people who needed to have pressure put on them immediately.
You all are the ones who lit them up on X. You all are the ones who even went to go see them in their office hours, went at the district. You all are the ones who wrote letters and kept the pressure on. And that’s the only way we fix this is if we the people remember that we’re the employers, we’re the ones in charge. So, and I’m saying this to myself too out loud, don’t feel defeated. We didn’t get what we wanted. And we’re pissed off about it. But don’t feel defeated. We need to stay active.
We need to remain loud and be heard. There will be another attempt for reconciliation bill in early 2026, according to speaker of the House, Mike Johnson. Will we have another shot to take the NFA, you know, and throw it away? Yes. But now that the tax is a zero, is the tax an issue? Will the parliamentarian be replaced? I don’t like that stuff, which is why it would be much easier just to have a law passed. But stay active, be heard. Guys, I appreciate y’all. Oh, let me know what you like.
