We’ve all been waiting for the assault weapons ban slash magazine ban cases to hit the United States Supreme Court, and we are that close, y’all, that close. So close that tomorrow, which is December 13th, not sure when you’re watching this, 2024, tomorrow the Supreme Court was supposed to hold a conference in which Snope v. Brown, which is the assault weapon ban case by our friends over at Second Amendment Foundation, it was supposed to be on the docket tomorrow. They were going to sit around and decide if they were going to take the case up or not, or push it off till after the holidays for another round of conference.

Well, yesterday, an order came out of the Supreme Court and it said, you know what, we’re not going to put it out for conference on the 13th of December. And that’s all it said, which is some people, if you look around the internet, you’ll see some people saying this is a good thing, which we’ll talk about. And other people are saying this is a terrible thing, which we’ll talk about a little bit. I think it’s somewhere in the middle. I’m hoping it’s somewhere in the middle for a couple of reasons. All right, so first off, the next scheduled conference for the Supreme Court is January 10th. And if you remember, I told you good things and bad things in a video I did a couple of days ago.

I’ll link it above. I did say that I fully expected them to punt this week and put it off till early January. Is it because they’re leaving early for their break for the holidays? That’s a possibility. But we’ll talk about the two ends of the spectrum here that some people are talking about. And both ends of the spectrum have great points. The people who say it’s a good thing, well, they’re saying it’s a more information, gather some more facts, and then have all their ducks in a row so that when they go to conference, they can get enough justices to agree to take up the case.

Remember, you need four justices to agree to take the case up. You need five justices to win a case. So that could be one angle. Another angle could be maybe they don’t have that fourth justice yet. And one of the justices like Alito Atomas are trying to sink their hooks into one of the justices that are maybe not interested in taking up an assault weapon ban case because it is absolutely huge for the last 30 to 40 years, actually since Bill Clinton, of gun control. Because if they do it the right way, they’re going to destroy it.

And the communist states are all scared, big scared. So that’s the other thing. And there’s also a couple other cases making their way through the system, one of which is right out of Rhode Island. It’s a magazine case. So maybe they’re going to combine those cases and take up magazine restrictions and semi-automatic AR-15 type rifle restrictions once and for all. That’s a good thing side. And then there’s the bad thing side. The bad side is generally, not to the letter of the law, but generally when they do that to a case, they typically don’t take it up, which means that they would not issue a writ of certiorari for this nope case.

But I will caution you there and remind folks that the New York State Rifle and Pistol Association case, they punted that a couple weeks, several weeks before they actually took it up. So I don’t read too far into either side. I wanted you to be aware of the potentials, but I think it’s somewhere in the middle. I think that they just wanted to go home and worry about that stuff after the holiday and then worry about the next iteration of the administration. That’s kind of what I think the angle is. Remember, we need four to take a case up.

We need five to win a case, because obviously there’s nine justices, and that’s where we’re at. I wanted you to have the information just plain. No Rome is burning. No, the sky is falling. Those are the two sides. It’s probably somewhere in the middle. I hope it’s more towards the good side, if I’m honest with you. I’m hoping it’s not towards the we don’t want to take the case up, because according to their landmark cases, Heller, McDonald, Catano, Bruin, and most recently, we’ve had cases where they’re working their way through that got GVR’d after Bruin granted certiorari, vacated the ruling, and remanded to the lower courts.

Like the night everybody knows the cases in California, all those cases that are working their way back up. So I hope that judiciously, judiciously, judiciously, it means that they’re taking the case up. They just probably need an extra couple days of sleep for the holiday to prepare for Christmas.
